Southfield C1981014: MT6 13 February 19, 2013 <br />4. In Table 11, the Conte well is listed as being constructed in Township 70 West, Range <br />68 West in the Division of Water Resources -State Engineer's Office permit. The <br />location of this well on the permit area needs to be confirmed and updated as <br />necessary. <br />5. Please assure that Table 11- Surface Water Rights is up to date. This table apparently <br />was last updated in 1988. [2.04.7(1)(iv)] <br />6. Please update section 4.05.13 to reflect reporting of water year from October 1 to <br />September 30 in accordance with Rule 4.05.13(4)(b). Annual Hydrology Reports are <br />generally due to the Division within 6 months after the end of the water year. Please <br />update the submittal date of the annual Hydrology Report in accordance with Rule <br />4.05.13(4)(c). <br />7. Section 4.03 of the permit refers to the haul road to the RDA. After cessation of <br />mining the haul road to the RDA was converted to an access road. Please assure that <br />this reference is consistent throughout the permit. Please revise Section 4.03 of the <br />permit to reflect the approved designation of the access road to the RDA. This section <br />should clearly state that this road has been approved to remain as a permanent road <br />in accordance with Section 2.05.5. <br />8. Please update Maps 14 and 15 to reflect remaining topsoil stockpiles. [Rule 4.06.3, Rule <br />2.10.3(1)(1)] <br />9. The Division has been notified of several structures that may have been affected by <br />subsidence; 3 fence comers that have pulled out of the ground and possible damage to a <br />historic cinder block bam. The Division requires EFCI to verify impacts to these <br />structures and conduct mitigation efforts in accordance with Rule 4.20.3, and permit <br />section 4.20.3, if determined that these impacts are a result of EFCI's mining activities. <br />10. The Corley Company Well (Division of Water Resources Permit No. 119459) is located <br />in Township 20 South, Range 70 West, NE'/ SE IA Section 24. The total depth of the <br />well is 100 feet and has been permitted for domestic use, livestock watering by the <br />Colorado Division of Water Resources. The Division of Water Resources Permit was <br />approved February 19, 1982. Southfield's Map 12: "Mine Area Surface and <br />Groundwater Hydrology" locates the Corley Company Well in NE'/ NW1 /4 Section <br />24, Township 20 South, Range 70 West. Please correct the location on the Southfield <br />mine maps. <br />The owner of the well believes the well has failed. The Corley Company Well (No. <br />119459) overlies an area that was mined by Energy Fuels. This location shows that <br />Energy Fuels conducted secondary mining (pillared) below this location in the Red <br />Arrow Seam in 2nd North mining area (Map 17: Mine Plan (dated December 1,1997), <br />and MSHA Final Workings Map (dated June 20, 2002). Please demonstrate that <br />Energy Fuels Coal Inc. has met the requirements of Rule 4.05.15 and Rule 4.20.3 <br />regarding the Corley Company Well. The Corley Company Well was reportedly <br />
