Everist, Inc. completed the Corre�ctive Actions noted in your inspection report, for the <br />inspection of the Fort Lupton Sand and Gravel mine on O ober 16, 2012._ The corrective actions required that: <br />"The Operator shall conduct a survey and replace the boundary markers in the correct location(s)." <br />L.G Everist respectfully submits a Permit Boundary Map and photographs taken in later January in the field as <br />proof that the survey has been completed and the permit boundary markers are in place. The map is an aerial <br />photo that shows the entire surveyed permit boundary of Fort Lupton Sand and Gravel. The red lines show where <br />fences are in place and black lines where boundary markers have been placed to delineate the boundaries A <br />copy of Map Exhibit B - Vicinity Map (from the amendment materials) is included for reference as well. <br />A summary list of the photographs taken of many of the permit boundary markers (and some fencing) is attached <br />with location descriptions. There are more markers in the field - some photographs did not come out well, so <br />have not been included. <br />Permit Boundary Overview <br />There is fencing along the entire northern and southern boundaries. The fencing is sporadic along the western <br />and eastern boundaries, so permit boundary markers were placed as needed for a visual line of sight from marker <br />to marker. The only non -mine, non -owned property within the permit boundary - the Rankin property - has a <br />fence around the entire property. <br />Where fencing was missing, permit boundary markers were placed on the permit boundary with two exceptions: <br />Markers along the South Platte River were placed as close to the river as possible on the west side <br />(basically on top of the bank), and no markers were placed on the east side of the river, as we will not be <br />affecting any of the small areas across the river from our mine site. <br />The markers were offset to the inside of the property border in the southwest section of the site - starting <br />from the southwest corner then north to the first section of fence shown on the attached Permit Boundary <br />map. (If the markers had been placed on the exact border in this area, they would have been in the <br />middle of the Lupton Bottoms Ditch and /or access roads.) <br />There are two markers at every surveyed point - a wooden lath post with pink tape was placed at the point when it <br />was surveyed. The operator double- marked all surveyed points with a dark green metal t -post with a white top. <br />Northern Boundary <br />The northern boundary is fenced and generally runs along the south side of Weld County Road 18, with one <br />private property jutting south of WCR 18 (Dodge property) and one permitted property ( "Blue Ribbon ") located on <br />the north side of WCR 18. The Dodge property is surrounded by fencing, and the Blue Ribbon property is also <br />surrounded by fencing. The northwestern corner is at WCR 18 and the bridge that crosses over the Lupton <br />Bottoms Ditch West Lateral.
