OTHER PERMITS AND LICENSES REQUIRED EXHIBIT M <br />The following permits are needed for the site: <br />1. County Special Use Permit <br />2. NPDES combined process water /storm water discharge permit — A NPDES permit will <br />not be needed from the Colorado Department of Public Health and Environment since <br />water will not leave the site until vegetation is sufficient to control erosion. <br />3. APEN— A fugitive air emissions permit will be needed from the Colorado Department of <br />Public Health and Environment since the site. The APEN is required to be submitted but <br />has not yet been submitted for the site. <br />4. A Substitute Water Supply Plan or Augmentation Plan from the Division of Water <br />Resources is not needed for the operation since this is not a wet pit that will leave a <br />gravel pit lake. Also, the existing water rights for irrigation can be used for industrial <br />purposes. See Exhibit G. <br />5. A County Road Access Permit will not be required for vehicles entering T Road. <br />6. A CDOT Access Permit will be required for access to State Highway 550 from T Road. <br />This application process has been started. <br />7. A Spill Prevention Control and Countermeasure (SPCC) Plan is needed for the mining <br />operation since the site tank storage exceeds 1320 gallons (there will be a 3000 gallon <br />tank and a 10,000 gallon tank). Other tanks that will be located on site will be associated <br />with the individual processing plants. Fuel will be brought to the site with a mobile <br />fueling truck. No spilled material will be allowed to leave the site and all tanks will have <br />secondary containment. In addition, the portable plants that will be on site from time to <br />time each have their own separate SPCC Plans. <br />8. No USCOE 404 permit will be necessary because no wetlands or waters of the U.S. will <br />be disturbed. <br />Uncompahgre Pit, February 2013 M -1 <br />
