January 28, 2013 C-1981-012/New Elk Mine LDS <br /> AVAILABILITY OF RECORDS—Rule 5.02.4(1): <br /> Work on the digital record database, described in the October 16, 2012 inspection report,was on-going. In the <br /> meantime,NECC continues to maintain paper records. The records were in compliance in Mr Thompson's office <br /> (see attached checklist). <br /> EXCESS SPOIL and DEVELOPMENT WASTE—Rule 4.09 <br /> Placement; Drainage Control; Surface Stabilization: <br /> The reclaimed Development Coal Waste Pile (DWDA 1) and the Development Waste Disposal Area(DWDA 2) <br /> appeared stable and well drained. There were no visible signs of erosion or instability. <br /> The third Development Waste Disposal Area approved in TR-65 (DWDA 3) did not yet exist on the ground. <br /> EXPLOSIVES—Rule 4.08 <br /> Distance Prohibitions 4.08.4;Warnings 4.08.4; Control of Adverse Effects 4.08.4: <br /> There were no explosives on site;NECC no longer holds an explosives permit. The area where explosives were <br /> stored previously was clear of trash and in good order. <br /> FISH and WILDLIFE—Rule 4.18: <br /> Evidence of the presence of wildlife was widespread over the site (tracks, scat,gnawed foliage, etc.). The Fish and <br /> Wildlife Plan described in section 2.05 of the permit states that mitigation of impacts to fish and wildlife will be <br /> achieved by "minimizing the total disturbed area during the life of the operation and by continuous efforts to <br /> minimize disturbance and pollution to the existing environmental resources... ". Observations confirm that the <br /> mine has been run in accordance with these principles to date;the western end of the site and the area around and <br /> including pond 4, in particular,provide valuable wildlife habitat within the disturbed area boundary. <br /> Recent disturbances, such as the pad to the north of the cell phone tower and the graded slope between the parking <br /> lot and the office building,have been seeded and hydro-mulched. This activity tends to minimize the scale and <br /> duration of the disturbance and gives NECC a head-start on reclamation of the site. <br /> HYDROLOGIC BALANCE -Rule 4.05 <br /> Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, 4.05.6; Discharge Structures 4.05.7, <br /> 4.05.10, Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water Monitoring 4.05.13; Surface Water <br /> Monitoring 4.05.13; Drainage—Acid and Toxic Materials 4.05.8- Impoundments 4.05.6, 4.05.9; Stream <br /> Buffer Zones 4.05.18: <br /> Hydrologic monitoring points(details in table 27 of the permit)were inspected and their physical locations <br /> recorded using GPS. All sites were well maintained. The GPS data that was collected during the inspection will be <br /> used to verify the mapped locations of the points,but is not included in this inspection report. <br /> Surface water and sediment control structures were inspected, and are described,by location,in keeping with the <br /> format used in recent inspection reports. <br /> At the western end of the mine site, from west to east: <br /> • The "water tank" SAE showed no recent disturbance. <br /> Number of Partial Inspection this Fiscal Year: 4 <br /> Number of Complete Inspections this Fiscal Year: 3 <br /> Page 3 of 13 <br />
