OBSERVATIONS <br />PERMIT #: M -1999 -098 <br />INSPECTOR'S INITIALS: PSH <br />INSPECTION DATE: January 30, 2013 <br />The Riverview Resource was inspected by Peter Hays with the Division of Reclamation, Mining and Safety <br />(Division) as part of the Division's monitoring inspection program. The site was previously inspected by the <br />Division on December 1, 2008 for a pre - operational inspection for Amendment No. 1. Mrs. Connie Davis with <br />Aggregate Industries, Inc was present during the inspection. <br />Financial Warranty: <br />The Division currently holds a financial warranty in the amount of $155,480.00, which appears adequate to <br />reclaim the site based on this inspection. <br />Hydrologic Balance: <br />Mining operations at the Riverview Resource have been put on hold due to economic conditions. Depletions <br />from groundwater loss due to evaporation, dewatering, dust control and the concrete batch plant are covered <br />by a SWSP. In the spring of 2011, the pit was flooded by the Poudre River during high spring runoff. The pit is <br />unlined and all exposed groundwater is covered in the current SWSP. Aggregate Industries has filed a final <br />augmentation plan in water court (Case No. 90CW23). Mrs. Davis stated the final augmentation plan is still <br />being review by the water court. <br />Gen. Compliance With Mine Plan: <br />The site was inactive at the time of the inspection. Mrs. Davis stated stockpiled material is used occasionally <br />for production of concrete at the batch plant located at the site. A rectangular section in the northeast corner <br />of Cell 3 is the last area to be mined in the cell. Mining will continue in CeII 2 once Cell 3 is finished. An <br />elevated conveyor with two river crossings will be required to mine the new cell. Cell 3 is currently flooded, <br />but is being dewatered slowly and the water is discharged to the Poudre River. <br />Amendment area: The amendment area approved by the Division in 2009 is undisturbed. Aggregate <br />Industries stated Phase 1 within Cell 4 of the Amendment area will not be mined and will be removed from the <br />permit boundary. The release of the undisturbed area must be requested by the Operator as required by Rule <br />4.17. <br />Revegetation and Reclamation: <br />The post mine land use for the site is open water ponds with wetlands. The reclamation and revegetation of <br />the wetlands area in the southern section of CeII 3 was observed and as noted in the previous inspection <br />report is well - established. No noxious weeds were observed and the Operator stated the area is frequently <br />inspected and treated for weeds. The highwall along the northwest section in the southeast corner of Cell 3 <br />needs to be regraded. <br />Support Facilities On -site: <br />An inactive processing plant, asphalt plant and concrete plant were observed in the northwest section of the <br />site. Stockpiles of product were observed near the processing plant and stockpiles of recycled asphalt and <br />concrete were located south and east of the processing plant. <br />Page 2 of 5 <br />
