WATER <br /> The Climax property encompasses the headwaters of <br /> three watersheds: the East Fork of the Arkansas River , the <br /> East Fork of the Eagle River , and East Fork Tenmile Creek. The <br /> Tenmile Creek watershed includes tributaries of Kokomo Creek <br /> and Searle Creek from the west and McNulty Gulch, Clinton <br /> Creek, Mayflower Creek, and Humbug Creek from the east. <br /> The base map, Exhibit C, shows the locations of major <br /> tributary water courses, reservoirs , canals ( and water handling <br /> facilities) on the affected land. There are no known aquifers <br /> on the Climax property. <br /> 8 .1 CLIMAX WATER RIGHTS <br /> The Climax Molybdenum Company has purchased and <br /> developed the water rights which are currently used as a water <br /> source for development and operation purposes. The water <br /> available to Climax under its decreed water rights is diverted , <br /> in some cases stored , and applied to beneficial use in an <br /> integrated water system and the diversions are made in priority <br /> under these decreed water rights as water becomes legally <br /> available. The diverted water is used in such a manner that an <br /> adequate supply is provided for domestic use , mining , <br /> milling , and tailing deposition. Future development, operation, <br /> and reclamation phases at Climax will not cause measurable , <br /> material injury to owners of senior water rights . Table 8 . 1 <br /> lists the Climax water rights as they are listed in the most <br /> recent tabulatin of decreed rights prepared by the division <br /> engineers for water divisions 2 and 5 . These water rights are <br /> capable of meeting current Climax water needs and are <br /> sufficient both physically and legally to_satisfy all project <br /> water requirements. <br /> 8 . 2 CLIMAX WATER REQUIREMENTS <br /> Domestic water requirements at Climax are <br /> approximately 400 gpm and mining requirements for drilling and <br /> 8-1 <br />
