JoEllen Turner <br />970 - 864 -7682 p.3 <br />he accused me of, I was over 300 miles away and had NO knowledge of any of this. I'm sure <br />once the Judge seen me on TV, Mr. Kamper and Mr. DeJoia would have looked pretty foolish. <br />The soils samples that Kamper accused me of running at random all over the property and <br />submitting soil samples from where ever was all untrue. Mr. DeJoia, himself, filled my baggies <br />and even told me what to put on them. TP -01, Tp -02, Tp -03, Tp -04, etc. and even gave me extra. <br />OSM was offered the very same thing and so was the State or anyone who wished to have any. <br />WHY OSM chose not to take any samples, is beyond us. Mr. DeJoia threw the samples in the <br />back of his pick up where he had TWO five gallon buckets of soils gathered from the Delta area <br />that he said was SALTY, NASTY stuff, KEY AGS exact words. The first pit, they forgot to <br />even take samples until I asked, are you going to take samples. Paychecks only, samples weren't <br />important, they weren't going to be done right anyway. I sent my samples into the place that <br />WFC has always used and the farmers here have used for 50 years and came up with completely <br />different answers. <br />WFC, DeJoia and Michael were all present together on the Morgan Property right next to the pit <br />water. Our attomey contacted Mr. Kamper and asked that Michael and Mr. DeJoiaTake water <br />samples together. Mr. Kamper refused to allow it. Ross Gubka and Lance also was asked right <br />then when they could have gotten collective samples, side by side, WFC refused. They also <br />would not allow Michael to take any more samples. Also, documented to the State as well as <br />Mr. Kamper and WFC that we had additional water samples if they wanted them, they refused. <br />Also documented to WFC and Mr. Kamper that we still have those samples, tightly sealed and <br />preserved in the refrigerator, lots o f them, and they still refused. <br />I was not present when any of the water samples were taken or some of the next soil samples. I <br />did not even know about them until I returned home. This was several times, not just once. All <br />of these things that Mr. DeJoia states are all untrue and unfounded and are coming from one <br />source, WFC. The results of the "PIT WATER" as well as the pit water itself was shipped to <br />OSM. They could have run their own test. The State could have run their own test. Sampling <br />has been done by WFC all along. They knew how bad it was, it did not take us to tell them They <br />had already failed one wet test even with the water diluted completely down. The trouble was, <br />this "pit water" was never diluted when used on this property. So, the sampling that Mr. DeJoia <br />refers to is a DILUTED down sample, diluted good enough to past the requirements, not the the <br />straight pit water that was being used for dust control. <br />The lab that I used and the lab results that I sent to OSM and to DRMS and to WFC were all <br />from the same lab that WFC uses, that Tri-State uses, that Mesa County uses, that Montrose <br />County uses, and guess what, 1 got the Address from the Colorado State Health Department. <br />After talking with Kelly Morgan, and fording out what the permit that they have issued allowed, <br />then we had the sampling done and the test. All the bottles and the paper work were acquired <br />very professionally. All of you were sent the results. So, Mr. DeJoia, I am sure that the Colorado <br />Health Department would like to know that you consider the lab I used as faulty and the results <br />just can't be accurate. <br />WFC has documented this in their VERY OWN documentation, even PRIOR to Mr. DeJoia. He <br />should pay closer attention to what already is documented, then it will save on repeats and so <br />many false statements being made. <br />There has been approximately(their figures even are higher) 38 acre feet of pit water used for <br />
