The Morgan property <br />always been one of the nicer and most productive farms in this are& Th Morgan farm has <br />always been historically irrigated and cropped and has been considered as prime farmland. <br />Permit Revision sion number 6 `Board Ordered" Western n Fuels to return all of the Morgan property <br />to prime farmland standards. MRCS has unanimously stated that all of the a 7 Morgan mined was Prime Farmland. The Court has enterentered ° property that <br />violations of the Rules and Regulations governing Judgement Western Fuels for <br />g eniing Z�me farmland and for Breach of the lease_ <br />The Morgan <br />property needs to be restored to the prime farmland shmdards that it had <br />mining and reclaimed according to prime farmland rules and prior to <br />Morgan property should. be allowed fa be than regulations. No portion of the <br />has already a changed from the prime farmland determination that <br />has al y been approved. Rules and regulations governing this are 2.04.12, a prime farmland <br />Investigation that had to be completed prior to wining. 2.06 The National soils survey to be used to make that detenmation and NRCS had to be contacted 1.04 The M rg dbook <br />in <br />property was always historically irrigated and cropped, not pasturelands since 1987. 4.25 The <br />soils had to be segregated and protected until redistribution and w ere not The operations farmland are very specific and these decisions had to all be perat o s for <br />prior any mining activities.
