Box 187 <br />Executive Director <br />Craig, CO 81626 <br />Loretta Pineda <br />Director <br />RE: Trapper Mine, C- 1981 -010 <br />Permit Renewal No. 6 (RN6), Adequacy Review No. 4 <br />Dear Mr. Luke, <br />The Division of Reclamation Mining and Safety (Division) received an application to renew the reclamation <br />permit for the Trapper Mine; Permit No. C- 1981 -010 on June 20, 2012. The application was called complete for <br />review on June 29, 2012. The decision date for the permit renewal application is January 31, 2013. The division <br />sent a follow -up review letter dated December 4, 2012. This letter cited four items that did not require action to <br />be taken by Trapper Mining, Inc. (TMI). Upon further review of the ownership and control information of the <br />permit, several items will need to be addressed prior to the approval of the application: <br />1.2.1 Officers, Directors and Members <br />1.) Each of the people listed in this section of the permit is a member of the Board of Directors for TML The <br />column title "Relationship to entity represented" is confusing. Several of the people listed that represent <br />an entity are not listed as a Director and/or an Officer for that specific entity. For example, Mike <br />Hummel is listed as a Board of Director for the Salt River Project Agriculture Improvement and Power <br />District under the column in question in section 1.2.1; however, Mr. Hummel is not listed as a Board of <br />Director under section 1.2.1(a) for this entity. The Division recommends removing the column heading <br />"Relationship to entity represented" from section 1.2.1. and either remove the information from this <br />column for each of TMI's Board Members or indicate that each of the members listed is on the Board of <br />Directors for TMI. <br />2.) For the Officers listed for Trapper Mining, Inc., if they are considered to be on the Board of Directors for <br />TMI they also need to be listed under the Directors section. Please review the dates provided for each of <br />the Officers and Directors. If a person is considered an Officer and a Director, the dates they assumed <br />their designated positions may be different. <br />1.2.1(a) Board of Directors of Owners <br />3.) For the following owners: <br />a. Salt River Agriculture Improvement and Power District <br />b. Platte River Power Authority <br />c. Tri -State Generation and Transmission Assoc, Inc. <br />If the Officers listed for each owner is also considered a Director, please add them to the Directors list as <br />well so that they are listed in both places. Please review the dates provided for each of the Officers and <br />Directors.
