APPLICATION <br />1. Page 4 — Based on the proposed phased bonding approach and the ultimate goal <br />of a developed water resource post -mine land use, the "Developed Water Resources" box <br />should be checked under Item 12 of the application. Please submit a revised page 4. <br />Response : <br />The applicant is proposing that the post mining land use to be rangeland, therefore <br />page 4 of the application is correct and does not need to be altered. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS — REGULAR 112 OPERATIONS <br />The following items must be addressed by the applicant in order to satisfy the requirements <br />of C.R.S. 34- 32.5 -101 et seq. and the Mineral Rules and Regulations of the Mined Land <br />Reclamation Board: <br />6.4.1 EXHIBIT A — Legal Description <br />This exhibit is adequate as submitted. <br />6.4.2 EXHIBIT B — Index Map <br />This exhibit is adequate as submitted. <br />6.4.3 EXHIBIT C - Pre - mining and Mining Plan Map(s) of Affected Lands <br />2. All three maps in Exhibit C imply Nyberg Road is intended to be included in the <br />permit boundary. The Division acknowledges that the pre- mining map includes a detail <br />illustrating the Stonewall Springs Quarry property boundary, but it is not clear as to the <br />intent of the permit boundary. Please clarify the Applicant's intent to include or exclude <br />Nyberg Road in the permit boundary. If the intent is to include the road, please provide a <br />source for the legal right of entry. <br />Response : <br />Nyberg road is a Pueblo County Road and is not intended to be included in the <br />permit boundary. The Pre - Mining Map has been revised to show that Nyberg <br />Road is excluded and not part of the permitted area. <br />3. Exhibit C Adjoining Landowners — US Highway 50 /State Highway 96 appears <br />to be within 200 feet of the proposed permit boundary. The Division assumes this <br />highway is owned by the Colorado Dept. of Transportation (CDOT), but they are not <br />identified as an adjacent landowner. Please identify the owner of the highway on Sheet 2 <br />of 2 and provide proof of notification. <br />Response: <br />US Highway 50/ State Highway 96 is within the 200 feet of the proposed <br />permit boundary. The Highways are owned by the Colorado Dept. of <br />Transportation (CDOT). The maps have been corrected and CDOT <br />(Colorado Dept. of Transportation) was notified please see their letter <br />below: <br />
