The Division acknowledges that this review of the 2011 ARR is far from timely.
In view of the fact that the ARR for 2012 is due in just a few weeks, (February 15, 2013), the Division
requests that New Elk Coal Company takes care to address the points raised above when submitting the
2012 ARR, rather than re-submitting the 2011 ARR.
