JoEllen Turner
970 - 864 -7682
p.5
not there. Our rights have been violated because WFC told all their employees that they
would be getting pink slips if they did not help get Pr -06 passed because we were trying
to shut the mine down. ALL LIES. Pr -06 was our property and putting our property back
the way it should be. AND we have not anytime tried to get the mine shut down, just
our soils from being stolen and from more damages being done to our property because
ALL OF THE RECLAMATION, REVEGETATION, AND SOIL SAMPLING AND PRIME
FARMLAND DETERMINATIONS HAD TO BE DONE PRIOR TO MINING UNDER THE
ACT AND ALL OF THESE HAD TO BE APPROVED WITH LANDOWNERS CONSENT
PRIOR TO EVEN THE PERMIT BEING APPROVED!!! The pre- conference hearing was
not a PUBLIC announcement, and in fact, I had to chase down the Federal Express
man to even get the notice just prior to the time of the meeting which was also a
violation of our rights. Our rights under the ACT have been violated because there is no
LANDOWNER coordination. Making major changes to our property and then allowing
us to comment and then ignoring our comments or the history of this place and ignoring
our documentations and then just going ahead and approving something causing
damages to our property is not land owner coordination. AND PR -07 is a prime
example. The point , our rights under the ACT have been violated, our civil rights under
the ACT have been violated, and our right to APPEAL a Boards decision to get a permit
revision under the ACT has also been violated. The results of the appeal has not even
been determined and it's been over two years and WFC has submitted a total
REBUTTAL to a BOARD ORDER and the STATE has accepted this which should have
never been allowed in the first place, again a violation of the ACT ,rules, and landowner
rights, and we are formally objection to the Renewal of the Permit, and to Permit
revision number 7 and if it is not thrown out, then we are demanding an informal hearing
in Nucla Colorado convenient to all and in a neutral location and convenient enough that
all these farmers and ranchers that have objected be allowed to attend. We are also
requesting an informal hearing for the permit renewal since our concerns, and our
objections are not recognized. Our rights were also violated when we requested the
Board to accompany us on sight and were denied, when we asked that we be allowed
to attend through video means so that all 35 objectors could attend and were denied,
we asked that the meeting be held so that all the people could view the mine and see
what was going on and we were denied. Actually the meeting was held in the dark, far
enough away that no one could see anything, and not one of the people such as OSM
could even make a walk over the property and see the violations. Our rights were
violated because we were limited to a very short 15 minutes per person to give
complaints that affected our entire lives_ We have had stockpiles and no production on
those areas mined for 10 years, again a violation of our rights under the ACT. We have
been deprived of our livelihood, and the people that the STATE submitted as people
FOR Pr -06 at the formal hearing were all about JOBS and nothing to do with PR - 06.
One even submitted for ENERGY FUELS nothing to do with us and ONE submitted for
NEW Horizon NORTH again nothing to do with PR and tha BOARD was not made
aware of those facts either, violating our rights under the ACT. And one of the MOST
important violations of the ACT is what has to be contained in the permit revisions and
permit applications and that is FACTUAL information and ACCURATE documentation
and the STATE has approved these things without making sure the information is
correct or accurate and like MR. Benys letter states of all the fraudulent entries and all
51 Page
