WE ARE DEMANDING TO <br />BE PRESENT AND DEMANDING TO BE IN ANY CONVERSATIONS REGARDING <br />OUR PROPERTY THAT INVOLVES NRCSIIII NRCS was not even consulted on this <br />and they will be given all facts and not just partial facts and lies as WFC presents them. <br />I am sending NRCS a copy of the Judgement which the JUDGE ruled that they not only <br />breached the lease and broke the rules but it was WFC duty to make sure the State had <br />the correct information. They are also in default of the lease which they have breached <br />and they were sent a default letter and a breach of the lease letter many years ago and <br />the Judge has confirmed this breach, None of our soils were suppose to leave this place <br />and they had to do a prime farmland investigation. As far as we are concemed, if this <br />incompetent, ridiculous revision continues, that contract will be null and void and we will <br />do anything and everything necessary to make sure our property is put back "as good <br />as or better', to the uses or higher' that it had prior to mining. But along the way, some <br />how we are going to get this message to any and everyone in the country about what <br />WFC, and the State is allowing to happen to this place. And if it was OSM's intentions to <br />try and change our prime farmland status and to believe that WFC only salvaged 22 <br />inches of soils, then I am ashamed of you and I want to see where this was in TR -61 as <br />Dejoia states and I want to see all of these requests that Dejoia said were given to him <br />by OSM and I think if there was such a request, I think we have a problem, since these <br />request were never presented to us and we would have absolutely objected and not <br />allowed the sampling, because if that was the purpose, then that violated all federal and <br />state requirements. We had 196,358 cubic yards stolen and I don't care what WFC <br />wants you to believe, we are requesting an informal hearing here and these ranchers <br />and farmers will prove to the contrary. t also will request the NRCS be here and since <br />this is not a COURT proceeding, they had better be allowed to come. Please send us all <br />the procedure packet as to what we have to do next. I have the States pretty well <br />learned. <br />Thank you, <br />JoEllen Turner <br />Michael Morgan <br />Frank and Mary Lou Morgan <br />Here are the rules and regulations being violated and have been violated and that this <br />revision is still violating: and we want to see these Amendments that Pr -07 refers to, <br />'new' version of the rules and regulations that allow you to do what you are doing since <br />we do not have a copy. We are requesting those as quickly as possible. <br />First off: Appropriate standards were suppose to be enforced to minimize damage to the <br />environment and the productivity of the soils. The primary governmental responsibilies <br />for developing, authorizing, issuing, and enforcing regulations for the surface mining <br />and reclamation operations subject to the Act is the States responsibility. <br />Assure that the rights of surface landowners and other persons with a legal interest in <br />the land are fully protected from mining operations. Make sure that the mining <br />operations protect the environment. This FARM and these soils are our environment_ <br />Anything around us is our environment. Of course, all the environmental specialist <br />should know that. It's not designed to protect the MINES wealth and jobs, it's designed <br />to protect the landowner. They are designed to allow to get the energy sources that can <br />meet the nations needs and protect the land owner while doing so. <br />27 1 Page <br />
