NRCS states that 4 feet is desirable, but the <br />rules and regulations state that the soils are to be returned to the DEPTH, QUALITY, <br />AND QUANTITY THAT WAS IN THE NATURAL EXISTENCE... Read the first <br />paragraph of the rules and then go further. The first paragraph address soils that may <br />be just 40 inches so there fore they cannot require the State to have the mine restore <br />more soils than what was there, but the next paragraph explains that the soils need to <br />be put back to the natural depth and that even the A lift should be thicker than it was. <br />Since they MIXED our soils and stole our A lift from the property the mixed lift is no <br />better now that a subsoil because it's all mixed up and they need to bring back BARX <br />2E soils like we had for our "A" lift and give us back what we had prime farmland prior to <br />mining. THIS IS ALSO WHAT NRCS TOLD THEM THEY SHOULD DO. WFC also <br />wrote an APOLOGY R E PLOYEES THAT THIS WAS ALL THE STATES FAULT BECAUSE <br />TOLD THEIR <br />THEY DIDN'T DO THEIR JOBS. <br />The rules and regulations do not allow for you to take our prime farmland West half that <br />had its own depth, quality, and quantity and steal from us again to fix what WFC has <br />stolen unless they want to pay us for the soils they have stolen. Our soils are of <br />commercial value and if you would check any and I mean ANY of your own sources, <br />you would see how much prime farmland soils are going for or even GOOD topsoil. The <br />East half which they stole the 196,000 cubic yards from will never be prime again and <br />not a 2E classification. They have done irreparable damages to us and by using bought <br />and paid for soil scientist is not the answer to fixing our property. As Lance stated, they <br />will spend millions before they will give the Morgans one dime. The sad part is, all we <br />ever wanted was our property restored to the condition it was prior mining and for 5 <br />years, we were promised that this would happen and for 5 years DRMS, OSM, NRCS, <br />and especially WFC has told us That it will all be put back and fixed like it was. This is all <br />a moving target. We get all the promises in writing and then they come up with another <br />way to try and screw us and to take our livelihood, our farrn, and everything else away. <br />And I said before, without the local farmers, there would not have been a coal mine here <br />and they made over 12 million dollars off our place alone, this non- profit organization. <br />Public Records. They may have paid Mr. Morgan $1.40 per ton, but that was clearly <br />known to them that this was JUST THE COAL, then put our property back. They sold <br />the coal and made $12 million dollars, but being non- profit, that not considered any <br />money. And by the way, I didn't know that WFC was providing all these services at no <br />charge and this was all free to the community and that our electricity should not cost us <br />anything. On the East side of 2700 road, I followed right behind the mine and reclaimed <br />the farms and EACI -1 AND EVERY FARMER WAS GETTING PRODUCTION FROM <br />THEIR PROPERTY WITHIN 2YEARS. 2 Years. Where is our 'TIMELY MANNER" that <br />the law requires. I will keep getting objections and sending them in.
