In fact, he was told that was ALL WFC salvaged was <br />the 22 inch mixed lift pile. Again, he was never given ALL the facts and Dejoia nor <br />Dunker can make a logical determination without ALL the facts and when I say ALL the <br />facts, we were not permitted at the "SIDE" meetings and this was suppose to be a <br />scientific evaluation, but somewhere along the line these hired guns were told that <br />ONLY 20,000 cubic yards were removed, also against the law. They also were not told <br />that PRIME FARMLAND rules and regulations require a "PRIME FARMLAND" <br />investigation PRIOR to mining and that the SOIL SURVEY is only 1/6th of that <br />investigation. They were also told a false hood on the water as well as was the STATE. <br />Mr. Morgan is and always has been the LEADING share holder of the CCC ditch and <br />MR. Morgan OFFERED ROSS GUBKA ON TAPE RIGHT THERE AT THE KITCHEN <br />TABLE SEVERAL TIMES TO GIVE WFC MORE WATER BUT ROSS SAID THAT <br />LANCE DID NOT WANT TO LEASE ANY MORE WATER!!!! We felt that 50 shares <br />would be plenty because that was ALL WE ever used as Mr. Morgan, himself, testified <br />under oath. <br />Avalon soils, what a joke. This is for slopes less than 25 %. Has anyone really read our <br />property. Our slopes were 0 tO 3 %. of course that's Tess than 25 %. But , prime farmland <br />requirements are for slopes less than 6 %. Our slopes were 0 to 3 %. Whats wrong with <br />these people? ZERO TO THREE PERCENT!!!!! And 3-6% slopes Well, dah, that's Tess <br />than 25 %. <br />AGAIN WHERE HAVE THEY EVER READ A PRIME FARMLAND INVESTIGATION <br />RULE ? ?? fOR PRIME FARMLAND THE SLOPES ARE NOT 15% OR LESS OR 25% <br />OR LESS, the slopes are less than 6 %. LESS THAN 6 %. Our slopes were 0 to 3 %. We <br />had Barx 2E soils, not just Barx and not just PRIME FARMLAND, we had the VERY <br />best prime farmland for this area. We didn't have Mivida either. We are not accepting <br />any of this. If they wanted to do a prime farmland investigation, then they should have <br />been here in 1998. If WFC wanted to question any of these determinations made by <br />their own soil scientist, then that needed to be done before they entered the Morgan <br />property just like the Judge said, If they want to question NRCS and USDA reports and <br />documentations, then they should have done those before they ever entered the <br />property. We have USDA reports since 1960, unlike Dejoias lies, 1960 people showing <br />our property with BARX soils and a unanimous decision by the Board, by NRCS, and by <br />OSM has confirmed all of this and not only once, but many documents and we are NOT <br />ACCEPTING THIS SO CALLED IMPROVED MAPPING AND NEW MAPPING AND <br />SOILS THAT DO NOT EVEN INDICATE WHAT WE HAVE HERE!IFII <br />Again Lewicki has NO CLUE. HE states that the average stripping for the Morgan East <br />portion was 22 inches. What lies. What false statements. 22 inches is what they brought <br />BACK to us that was in stockpiles EAST of 2700 road, not what was salvaged. They <br />stockpiled our soils East of 2700 road because there was no place to put the soils while <br />they removing them. These soils were not suppose to leave our property, but were <br />earmarked as ours as we were told until they could bring them back. WFC documented <br />themselves in 2000, read the permit that the AVERAGE depth of our topsoils <br />EXCEEDED 47 inches _ They are being totally ridiculous. FIGURE the maps yours <br />selves.
