OBSERVATIONS <br />PERMIT #: M -1980 -183 <br />INSPECTOR'S INITIALS: BMK <br />INSPECTION DATE: December 14, 2012 <br />The Division conducted a monitoring inspection of the site in a response to a written complaint from a citizen, Mrs. <br />Winfred Bromley, who resides at 12801 Brighton Blvd. Mrs. Bromley indicated that the basement of her rental property <br />and adjacent pasture land are now under water from the mining activities being conducted adjacent to her property. <br />Her property is surrounded by the Stagecoach pit MLRB # M- 1983 -067 to the south and west; by the Worthing Pit MLRB <br /># M- 1977 -526 (Albert Frei & Sons) to the west and north and by Pit # 29 MLRB # M- 1980 -193 (Brannan) Sand and Gravel <br />to the east. <br />Berhan Keffelew and Tom Kaldenbach of the Division met with Fred Marvel and Tom Hanson representing the operator <br />and Mr. Norm Einspahr the owner of the pasture land that is flooded. The meeting took place at Mr. Einspahr property. <br />Mr. Einspahr pointed out his flooded pasture land and stated that this was the first time his pasture land was flooded. <br />He also stated that the flooding started along the east side of his property. <br />The Division has cited the flooding of the pasture land as a possible problem caused by the current activity at the mine. <br />The operator currently is monitoring the ground water elevation at three piezometer locations around the pit. The <br />results are submitted to the Division on a quarterly basis. Piezometer # 004 which is considered a hydrologic pinch area <br />is located between two slurry walls, Stagecoach Pit MLRB # M- 1983 -067 and the Brannan Sand and Gravel Pit # 29 MLRB <br /># M- 1980 -193. It had a significant rise in water table elevation in the last quarter readings. According to Mr. Einspahr, <br />the storage pond being filled to capacity and the significant rise in the water table elevation in piezometer # 004 appear <br />to correlate with the flooding of his pasture land. Because of the lack of access to the piezometer # 004 area at the time <br />of the inspection, no readings were taken. In order to verify if the rise in water table is associated with activities in the <br />Brannan pit # 29, causing the pasture land to be flooded and possibly caused Mrs. Bromley's basement to be flooded, <br />monitoring of the piezometer and water storage pond elevation is necessary. The Division recommended the operator <br />place two transducers one in Piezometer # 004 and another one in the water storage pond to see if any fluctuation in <br />the storage pond elevation is reflected in the piezometer # 004 readings. The operator agreed to place the transducers <br />as recommended as soon as possible. If the rise in water table readings in the pond and Piezometer # 004 correlates <br />with the amount of water flooding the pasture land, Brannan sand and gravel will need to submit a revision to the <br />permit to address the issue. <br />Page 2 of 4 <br />
