This report documents observations concerning compliance with the terms of the permit <br />and applicable rules and regulations of the Mined Land Reclamation Board. <br />The following inspection topics were identified as having Problems or Possible Violations. OPERATORS <br />SHOULD READ THE FOLLOWING PAGES CAREFULLY IN ORDER TO ASSURE COMPLIANCE <br />WITH THE TERMS OF THE PERMIT AND APPLICABLE RULES AND REGULATIONS. If a <br />Possible Violation is indicated, you will be notified under separate cover as to when the Mined Land <br />Reclamation Board will consider possible enforcement action. <br />INSPECTION TOPIC: Hydrologic Balance <br />POSSIBLE PROBLEM: Failure to minimize disturbance to the prevailing hydrologic balance C.R.S 34- 32.5 -116 ( h) <br />of the Construction Materials Act and Rule 3.1.6(1) by allowing ground water to mound in adjacent properties; <br />and failure to protect areas outside of the affected land from damage occurring during mining or reclamation <br />C.R.S 34- 32.5 -116 (4)(I) of Construction Materials Act and Rule 6.3.3 (1), by allowing the ground water to <br />adversely impact adjacent property. <br />CORRECTIVE ACTIONS: The operator will place two transducers one in the water storage pond and another in <br />piezometer # 004 and monitor fluctuations and see if the adjacent pasture land water cover is related to pond <br />water volume.
