Messrs. Morley & Gagliano
Page 7
December 24, 2012
Phase one. None of the provided maps indicate where the Central Reservoir is to be
located. Please clarify and/or correct all references to Phase One, Phase Two, etc. on all
maps and text references.
25. Based on information presented in Exhibits C through E, the Division has inferred that
slurry walls will be constructed in accordance with OSE standards, leak tested and the
engineer's certification provided to the Division prior to exposing groundwater.
However, these steps have not been stated explicitly. Please commit to these steps prior
to exposing groundwater or clarify the Applicant's intent.
6.4.8 EXHIBIT H — Wildlife Information
This exhibit is adequate as submitted.
6.4.9 EXHIBIT I — Soils Information
This exhibit is adequate as submitted.
6.4.10 EXHIBIT J — Vegetation Information
This exhibit is adequate as submitted.
6.4.11 EXHIBIT K — Climate
This exhibit is adequate as submitted.
6.4.12 EXHIBIT L — Reclamation Costs
26. If the Applicant wishes to pursue a phased bond approach, Exhibit L needs to include the
final reclamation cost estimate. These cost should be broken down by the phases shown
in the mining plan, then ending with the final reclamation plan as the Applicant proposes
the site to look like upon the completion of mining and reclamation. The Division would
review and comment of the total bond. After an amount is agreed upon, the Division
would require a bond be submitted only for the first phase of the proposed operation.
Please include bond calculations for all six phases up to and including the proposed water
storage features and slurry walls. (NOTE: the Division checked the submitted Exhibit L,
assumed to be representative of Please 1 and estimates a bond of $48,273 is more
appropriate. Please see the attached summary sheet).
6.4.13 EXHIBIT M — Other Permits and Licenses
This exhibit is adequate as submitted.
6.4.14 EXHIBIT N — Source of Legal Right to Enter
This exhibit is adequate as submitted.
