Messrs. Morley & Gagliano <br />Page 6 <br />December 24, 2012 <br />has ruled this material needs to be incorporated into a mine reclamation permit. The <br />Board Order is attached. Please discuss where this material is to be used in reclamation <br />and include its location on Exhibit C, and Exhibit F if appropriate. <br />6.4.6 EXHIBIT F — Reclamation Plan Map <br />19. There is a dry pit shown on the west end of the proposed permit area. No discussion of <br />this pit being left open was provided. There is a potential for this open pit to collect <br />stormwater. Please be aware that any collected stormwater must be released or infiltrate <br />within 72 hours. The Division requires the following specific reclamation information for <br />this dry pit: <br />a. Depth, <br />b. Side slope, <br />c. Revegetation — side slopes and bottom, <br />d. Stormwater interception and retention duration estimate. <br />20. There are no developed water resource features shown on the reclamation plan map. If <br />the Applicant intends to pursue the phased bond approach, the ultimate reclamation <br />configuration needs to be presented in this application or an amendment application will <br />be required prior to initiating the previously discussed developed water resource features. <br />Please provide the following information on Exhibit F: <br />a. Grading plans showing final reclamation slopes, <br />b. Which areas are to be reclaimed as rangeland, which are water storage, <br />c. Locations of proposed pipelines and discharge points (if applicable). <br />21. Section 3.1.5(1) Grading indicates materials excavated for the Excelsior Ditch relocation <br />may be used for the construction of permanent visual berms. Please show these berm <br />locations on Exhibit F, or commit to submitting either an amendment application or <br />technical revision, to be determined through consultation with the Divison, prior to <br />constructing the visual berms. <br />22. Similar to Comment 2 above, the Exhibit F map implies Nyberg Road is intended to be <br />included in the permit boundary. Please clarify the Applicant's intent to include or <br />exclude Nyberg Road in the permit boundary on the map. <br />6.4.7 EXHIBIT G — Water Information <br />23. Section (1) Impact to groundwater — the second sentence indicates there is expected to be <br />some degree of impact on the groundwater flow regime. Please provide some discussion <br />on the impact the operation is expected to have on local well users (within 600 feet) <br />access to and quantity of groundwater. <br />24. There appears to be some discrepancy between text and Exhibit C — Mining Plan Map <br />and Phase One. The Exhibit C map indicates Phase One is the 9.7 -acre disturbance on <br />the west end of the proposed operation. Section (1) indicates the "Central Reservoir" is <br />
