Similarly with Nyberg Road; Exhibit D indicates Pueblo County owns the road. Please
identify Pueblo County as the Nyberg landowner on Exhibit C, Sheet 2.
6. There appears to be a discrepancy between Sheet 1 and Sheet 2 with respect to the
proposed permit boundary in the vicinity of the Douglas, Kirchner, Evans, and Stueve
properties. Sheet 2 suggests these four properties are in the permit boundary (bold
double- dot -dash line), whereas Sheet 1 indicates they are not. Please clarify which is the
case and revise the appropriate sheet.
7. Rule 6.4.7(2)(a) requires water wells be located on the map (in Exhibit C) if surface or
groundwater systems are expected to be affected. The proposed later stage mining is
expected to expose groundwater as the Divisions understands it. A technical revision is
proposed to change the mining and reclamation plan at an as yet to be determined future
time. Technical revisions do not require public notice. Please revise Exhibit C to
identify and locate any groundwater wells within 600 feet of the proposed permit
boundary or add a statement to the map indicating "No groundwater wells are located
within 600 feet of the proposed permit boundary."
8. Rule 6.4.3(g) requires the type and location of all significant structures within 200 feet of
the affected area be shown on a map. Please identify the type and location of structures
particularly in the vicinity of the Douglas, Kirchner, Evans, Stueve, Smith and Cawlfield
properties.
6.4.4 EXHIBIT D — Mining Plan
9. The proposed method of mining states groundwater will not be exposed and that the
bottom of the excavations will remain two feet above the water table. Given the current
drought, the Division is concerned about the water table rising in the future when the
drought abates and the potential to expose groundwater under wetter climactic conditions.
The intent of two foot excavation limit by the Division is that the two -foot limit is with
respect to historic highest groundwater level.
a. Please indicate how groundwater levels will or have been determined such that
the appropriate bottom of pit elevations can be established.
