However, there are statements that appear to <br />conflict with other statements and some punctuation omissions challenge the Division's <br />ability to understand the intent. <br />APPLICATION <br />1. Page 4 — Based on the proposed phased bonding approach and the ultimate goal of a <br />developed water resource post -mine land use, the "Developed Water Resources" box <br />should be checked under Item 12 of the application. Please submit a revised page 4. <br />6.4 SPECIFIC EXHIBIT REQUIREMENTS — REGULAR 112 OPERATIONS <br />The following items must be addressed by the applicant in order to satisfy the requirements <br />of C.R.S. 34- 32.5 -101 et seq. and the Mineral Rules and Regulations of the Mined Land <br />Reclamation Board: <br />6.4.1 EXHIBIT A — Legal Description <br />This exhibit is adequate as submitted. <br />6.4.2 EXHIBIT B — Index Map <br />This exhibit is adequate as submitted. <br />6.4.3 EXHIBIT C - Pre - mining and Mining Plan Map(s) of Affected Lands <br />2. All three maps in Exhibit C imply Nyberg Road is intended to be included in the permit <br />boundary. The Division acknowledges that the pre- mining map includes a detail <br />illustrating the Stonewall Springs Quarry property boundary, but it is not clear as to the <br />intent of the permit boundary. Please clarify the Applicant's intent to include or exclude <br />Nyberg Road in the permit boundary. If the intent is to include the road, please provide a <br />source for the legal right of entry. <br />3. Exhibit C Adjoining Landowners — US Highway 50 /State Highway 96 appears to be <br />within 200 feet of the proposed permit boundary. The Division assumes this highway is <br />owned by the Colorado Dept. of Transportation (CDOT), but they are not identified as an <br />adjacent landowner. Please identify the owner of the highway on Sheet 2 of 2 and <br />provide proof of notification. <br />4. Exhibit C Adjoining Landowners — There appears to be some discrepancies between <br />parcel numbers and land owners when compared to the list in Rule 1.6.2(1)(e) and the <br />Pueblo County Assessor's website. Please provide corrections and/or clarifications on the <br />following: <br />
