Compliance With Mine Plan <br />N - Support Facilities Not On -site <br />N - Other <br />N - Special Categories Of Mining <br />R - Processing Waste <br />R - Topsoil <br />COMMENTS <br />This was a complete inspection of the Elk Creek Mine conducted by Brock Bowles of the Colorado Division of <br />Reclamation, Mining & Safety. The weather was mostly clear with no wind and the ground conditions were dry <br />with some muddy spots on the Bear Creek Road. Jim Kiger of Oxbow Mining was present for the inspection. <br />AIR RESOURCE PROTECTION — Rule 4.17: <br />A unit train was being loaded during the inspection. The coal crusher, conveyors, silo and surge loading <br />bin were also in operation. The longwall miner was not in operation but some underground development work <br />was being done with a continuous miner. Small amounts of coal were being stacked and the overall size of the <br />coal stockpile was small. There was no evidence of fugitive dust on site or off. A hotspot in the coal stockpile <br />was emitting a small amount of smoke (photo 1). Two bull dozers were moving coal on the stockpile to get to the <br />hotspot. Two water trucks and the tower sprinkler were spraying the area. <br />AVAILABILITY OF RECORDS — Rule 5.02.4(1): <br />All files were available for review at the OMLLC office. See attached availability of records checklist. <br />EXPLOSIVES — Rule 4.08 C Distance Prohibitions 4.08.4; Warnings 4.08.4; Control of Adverse Effects 4.08.4: <br />The area around the detonation cap and explosive lockers was free and clear of debris and vegetation. <br />FISH and WILDLIFE — Rule 4.18: <br />A golden eagle was seen flying down the Bear Creek Canyon just north of the Bear Creek Fan. <br />HYDROLOGIC BALANCE - Rule 4.05 C Drainage Control 4.05.1, 4.05.2, 4.05.3; Siltation Structures 4.05.5, <br />4.05.6; Discharge Structures 4.05.7, 4.05.10; Diversions 4.05.4; Effluent Limits 4.05.2; Ground Water <br />Monitoring 4.05.13; Surface Water Monitoring 4.05.13; Drainage — Acid and Toxic Materials 4.05.8; <br />Impoundments 4.05.6, 4.05.9; Stream Buffer Zones 4.05.18: <br />The clean water diversion ditch above and east of Pond D needs to be cleaned (photo 2).
