Stipulation No. 17: <br /> Prior to secondary or retreat mining under Apache Canyon, the Permittee must <br /> submit to the Division sufficient evidence for the Division to make findings that the <br /> operation will: <br /> 1) Not interrupt, discontinue, or preclude farming on the alluvial valley floors. <br /> 2) Not cause material damage to the quantity of ground water that supplies the <br /> alluvial valley floors. <br /> 3) Preserve the essential hydrologic functions of the alluvial valley floors. <br /> The stipulations to be addressed in this assessment which apply to Ciruela Canyon <br /> include: <br /> Stipulation No. 8: <br /> Prior to secondary or retreat mining at the Golden Eagle Mine, the Permittee shall <br /> provide a hydrologic survey identifying all alluvial aquifers in, or adjacent to the <br /> permit area (except for the Purgatoire River alluvial aquifer which has already been <br /> identified). This survey shall contain information concerning depth below the <br /> surface, horizontal extent, water use, and quantity and quality of ground water as <br /> required under Rule 2.04.70). The Pemittee shall also provide a discussion of the <br /> probable hydrologic consequences of mining upon those alluvial aquifers identified. <br /> Stipulation No. 12: <br /> Prior to secondary or retreat mining under Ciruela Canyon, Apache Canyon, and <br /> Santistevan Canyon drainages, the Permittee must collect data on the quantity of <br /> water flowing in these drainages. Monitoring must be sufficient to differentiate <br /> seasonal flow variations. <br /> The Permittee must monitor the quality of water flowing in Ciruela Canyon <br /> quarterly. Monitoring must be done at two sites, one above the mine water <br /> discharge point and one below the coal processing waste pile. <br /> The Permittee shall provide an assessment of the probable hydrologic consequences <br /> of secondary or retreat mining on the quantity and quality of surface water in <br /> Ciruela, Apache and Santistevan Canyons. <br /> -2- <br />
