21.5 Acre Study Area - Second Year's - Plant Cover) averaged 80.80 percent, which in <br />greater than the Irrigated Pasture Reference Area average "allowable plant cover" value of <br />62.47 percent, (Appendix 1 -Table 10, Irrigated Pasture Reference Area - 2008 Plant <br />Cover), it can be concluded that "allowable plant cover" satisfies the Phase III bond <br />release revegetation success criteria. <br />With respect to the first years' cover on Irrigated Pasture Reclamation IP -3 20.5 area site, <br />since sample adequacy was achieved for plant cover sampling on both the reclaimed <br />(Nm =5.1) and reference area (Nm =14.5) sites sampled for Phase III Bond Release in 2009, <br />according to Rule 4.15.11(2), the revegetation success comparison can be made by "direct <br />comparison." Since the mean "allowable plant cover" of the Irrigated Pasture Reclaimed <br />Site sampled in 2009 (Appendix 1 -Table 8, Irrigated Pasture Reclamation Phase III <br />20.5 Acre Study Area - First Year's - Plant Cover) averaged 81.13 percent which in <br />greater than the Irrigated Pasture Reference Area average "allowable plant cover" 62.47 <br />(Appendix 1 -Table 10, Irrigated Pasture Reference Area - 2008 Plant Cover), it can be <br />concluded that "allowable plant cover" satisfies the Phase III bond release criteria has <br />been satisfied. <br />With respect to the second years' production on Irrigated Pasture Reclamation IP -2 area <br />(21.5 acre) site, since sample adequacy was not achieved for production on either the <br />reclaimed (Nm =44.7) or reference area (Nm= 116.5), but the mean desirable production of <br />the Irrigated Pasture Reclaimed IP -2 Area 68.37 grams per one quarter square meter <br />(Appendix 1 -Table 7, Irrigated Pasture Reclaimed Area IP -2 21.5 Acre Area - 2009 <br />Production), exceeds the Irrigated Pasture Reference Area production success standard of <br />48.10 grams per one quarter square meter (72.16 X .90 % X 0.7407 soil correction <br />factor), the requirements of Rule 4.15.11(2) can be used. According page 13 of the BIO- <br />Logic 2009 Report, the calculated t value equals 2.356, which is greater than the t, of <br />1.297, therefore, Ho is rejected and revegetation is deemed successful. <br />With respect to the first years' production on Irrigated Pasture Reclamation IP -3 (20.5 <br />acre) since sample adequacy was not achieved for production on either the reclaimed <br />(Nm =44.7) or reference area (Nm= 116.5), but the mean desirable production of the <br />Irrigated Pasture Reclaimed IP -3 Area, value of 77.27 grams per one quarter square meter <br />(Appendix 1 -Table 9, Irrigated Pasture Reclaimed Area IP -3 20.5 Acre Area - 2009 <br />Production) exceeds the Irrigated Pasture Reference Area production value of 64.94 grams <br />per one quarter square meter (Appendix 1 -Table 11, Irrigated Pasture Reference Area - <br />2009 Production, the requirements of Rule 4.15.11(2) can be used. According page 14 of <br />the BIO -Logic 2009 Report, the calculated t value equals 2.0772, which is greater than <br />the t, of 1.297, Ho is rejected and revegetation is deemed successful. <br />Statistical calculations found in the IME 2010, 2011, and 2012 Reports, documents that in <br />all instances the Irrigated Pasture Reclaimed Areas studied in these years meet the <br />revegetation success standards for "allowable plant cover" and "desirable forage <br />production." The NH2 Mine Permit requires that at least 75 percent of the forage <br />SL -14 03DEC12.wpd 52 <br />
