Box 68
Empire, CO 80438
RE: Environmental Protection 'laps for Climax and Henderson, File Nos.
M-77-4P3 and M-77-342
Dear Mr. Jones:
The Division is in receipt of the Environmental Protection Plans for the
above referenced facilities. Thank you for the effort put forth by
yourself, the personnel at the facilities, and your consultants in
preparing these plans and providing them to the Division by the specified
deadline. Since these plans are being reviewed as technical revisions to
the permits, there is a statutory requirement to make a decision on their
acceptance and approval within 30 days. Given the complexity of the sites
and the large number of environmental protection facilities identified,
as well as the likely necessity of site inspections prior to approval, the
Division is requesting that you provide a written waiver of your right to
a 30 day decision date. Please be assured that it is the Division's
intention to be ready to discuss the adequacy of the plans as submitted
prior to the end of September.
Thank you for your consideration.
Sincerely,
Allen C.
