r
Memo to Bryce Romig 2 August 4 1998
Condition No. 2, third paragraph:
Specify the location of the concurrent sampling point(s) in the East Fork of the Eagle River.
Condition No.2,fourth paragraph:
Suggested Additional Language: if the data demonstrate-that anti degradation;type standards have
been exceeded during the first three years -f reservoir releases,DMG's consideration of f na1 approval
' .' ;'.r...ehl
of SR-2 will be'continued while an investigation is'conducted intd.the source of contaminants that
caused the anti degradation,tYPe standards to be"exceeded. The plan for the investigation wzll be
developed by Climax and subject to I3MG review and appoval..':If the investigation determines, that the
contaminant source is related to operations at the Climax Mine;the, souree must tie:eliminated or
mitigated in'accordance with a plan approved bp,DMG prior to SR-2 final apprgyal.
Contingency Monitoring and Response Plan (Condition No.2),third bullet:
Suggested Additional Language: If there insufficient reason to believe thifan emergency condition
exists related to aquatic life in-the Eagle River, based either on the water guality`data,`observations,of
the condition of the aquatic life;,or:other pertinent;criteria, the'DM may require Climax, toc immediate ly
reduce or discontinue discharge from;the eagle Park,Reservoir such that water'guality standards`iii`the
.._
stream will be met.
Miscellany:
1. The second quarter 1998 water quality data for Eagle Park Reservoir has been reviewed by the
DMG. The reservoir water quality continues to be very good, and is suitable for the post mining land
use of developed water resources. As a result, proposed Condition No. 1 in the draft resolution can be
eliminated.
2. The current decision date for SR-2 is August 31, 1998. As documented in the DMG's 7/1/98
inspection report, there are still some physical reclamation issues to be completed prior to conditional
approval of SR-2. You have reported that the required reclamation work is not yet complete, and as we
discussed, I will be unavailable to inspect the site from August 10, 1998 until sometime in early
September 1998. In order to maintain the August 31, 1998-decision date for conditional approval,
another condition could be applied to SR-2 stating that the required physical reclamation work will be
completed-,on a timely basis and will be subject to inspection and acceptance by the DMG.
3. As we discussed, you will prepare another draft of the Resolution of Findings and Conditions for
Eagle Park Reservoir Water Delivery and provide a copy for DMG review. The DMG did not consult
with Water Quality Control on the first draft, but will seek such consultation for the second draft. Based
on consultation with the Water Quality Control Division, additional modifications to the draft resolution
may be necessary. Our target date for finalization of this resolution is August 13, 1998.
