The inspection was directed at activities involved in the 4-Dam (a.k.aragTe <br /> Park Reservoir) tailing removal project and subsequent preparations to convert the <br /> facility to fresh water storage. We discussed the following items and agreed that <br /> clarification or additional correspondence would aid in securing project acceptance. <br /> 1. In the inspection report, the Division indicated that a request for waiver of the slope <br /> provisions of Rule 3.1.5(7) would need to be provided for slopes in Eagle Park <br /> Reservoir. Attached is a copy of the most recent survey of Eagle Park showing <br /> areas between high and low water mark where slopes will be greater than 3:1. As <br /> we discussed in November, steeper slopes in the reservoir basin are in locations <br /> where bedrock or indurated materials will provide stable shore features. While <br /> slopes were reduced around the perimeter of the reservoir during the Eagle Park <br /> project, no slope stability concerns have been identified since water impoundment in <br /> the basin began in the early 60's. Current grade on slopes and slope combinations <br /> above and below the expected water line are compatible with surrounding slopes <br /> and the intended land use. Limited fishing and facility maintenance access will be <br /> allowed on the east and south end of the reservoir and swimming is not viewed as a <br /> post-mining land use for this reservoir. <br /> Maximum high water mark for the reservoir is 10,717.5 feet MSL and the invert for <br /> the outlet works is 10684 feet. Operational water level has not been established for <br /> the reservoir at this time. Climax formally requests a waiver of the conditions of Rule <br /> 3.1.5(7) following Division review of the attached reservoir configuration. <br /> 2. The Robinson Seep Cutoff wall is a certified and approved Environmental Protection <br /> Facility that was briefly visited during your November inspection. At that time, I <br /> indicated that placement of water level probes in the same housing that contained <br /> the pumps was the subject of some discussion recognizing operational and <br /> maintenance limitations associated with the approved design. Climax has since <br /> experienced erroneous probe readings due to wet conditions surrounding the torque <br /> arrestors supporting the pumps.
