2.07.3 Government Agency and Public Comments on Permit Applications. <br />(1) Upon submission of an application for permit or revision or renewal <br />thereof, the Division shall, within 10 days of receipt of said application, <br />review the submission and determine if it is complete. If the <br />application is complete, the applicant shall be duly notified and the <br />application shall be considered filed for purposes of the Act. If the <br />application is incomplete, notice to that effect shall be mailed to the <br />applicant within said 10 -day period, and the applicant shall be given the <br />opportunity to amend, review, or otherwise make said application <br />complete. <br />(2) At the time of submission of an application for a permit, or for a permit <br />revision, technical revision, or renewal of an existing permit, the <br />applicant shall submit to the Division the proposed notice of publication <br />of the ownership, precise location, and boundaries of the land to be <br />affected by the proposed surface coal mining operation. Upon <br />notification to the applicant that the application for permit or the <br />application for a permit revision or renewal is complete, the applicant <br />shall place the notice of ownership, precise location, and boundaries of <br />land to be affected by the proposed surface coal mining operation in a <br />local newspaper of general circulation in the locality of said operation. <br />This publication shall be published at least once a week for four <br />consecutive weeks. The publication shall contain, at a minimum, the <br />following information: <br />(a) The name and business address of the applicant; <br />(b) A map or description which shall: <br />(i) Clearly show or describe towns, rivers, streams, or other <br />bodies of water, local landmarks, and any other information, <br />including routes, streets, or roads and accurate distance <br />measurements, necessary to allow local residents to readily <br />identify the proposed permit area; <br />(ii) Clearly show or describe the exact location and boundaries <br />of the proposed permit area; <br />(iii) State the name of the U.S. Geological Survey 7.5- minute <br />quadrangle map(s) which contain(s) the area shown or <br />described; and <br />(iv) If a map is used, indicate the north point. <br />(c) The location where a copy of the application is available for public <br />
