Should the total surface area exposed exceed those amounts, an amendment <br />will need to be filed with this office. <br />5. Denver Water may use the mounding drain water for gravel pit operations including dust <br />control, fire control, and a concrete batch plant. All water delivered to the pre -81 pond <br />will be metered and must be considered 100% consumptive with replacements made at <br />any time the site is subject to a call on the river. This SWSP does not authorize any <br />water lost with mined product and other than clean up of stockpile within the Hazeltine <br />Reservoir, there is not mining projected to occur in this SWSP approval period. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of this <br />water must first be approved by this office. Any future additional historic consumptive <br />use credit given (e.g., agricultural water transfer) for this site must consider all previous <br />credits given. <br />7. All releases of replacement water must be sufficient to cover all out -of- priority depletions <br />in time, place, and amount and must be made under the direction and /or the approval of <br />the water commissioner. The release of replacement water may be aggregated to <br />maximize beneficial use. The water commissioner and /or the division engineer shall <br />determine the rate and timing of an aggregated release. <br />8. The name, address, and phone number of the contact person who will be responsible for <br />the operation and accounting of this plan must be provided on the accounting forms <br />submitted to the division engineer and the water commissioner. <br />9. All diversions shall be measured in a manner acceptable to the Division Engineer. The <br />Applicant shall install and maintain such measuring devices as required by the Division <br />Engineer for operation of this SWSP. In addition, the applicant shall maintain daily <br />records of all diversions, replacements, and the amount of water used for each particular <br />purpose. The applicant shall provide a report of these records to the division engineer <br />and the water commissioner on a monthly basis on a form approved by them. The <br />accounting must be submitted to the division engineer in Greeley <br />(Div1Accountingtc7i state.co.us) and the water commissioner (Bill Schneider at <br />William .Schneider(c�state.co.us) within 30 calendar days of the end of the month for <br />which the accounting is being made. All amounts shall be in acre -feet. All submitted <br />accounting shall conform to the Administrative Protocol "Augmentation Plan Accounting, <br />Division One — South Platte River" (attached). <br />In addition, Denver Water shall ensure all replacement water released to the river on <br />behalf of this SWSP is included in Denver Water's municipal accounting. <br />10. The approval of this substitute water supply plan does not relieve the Applicant and /or <br />landowner of the requirement to obtain a Water Court decree approving a permanent <br />plan for augmentation or mitigation to ensure the permanent replacement of all <br />depletions, including long -term evaporation losses and lagged depletions after gravel <br />mining operations have ceased. If reclamation of the mine site will produce a permanent <br />water surface exposing post -80 groundwater to evaporation, an application for a plan for <br />augmentation must be filed with the Division 1 Water Court at least three (3) years prior <br />to the completion of mining to include, but not be limited to, long -term evaporation losses <br />and lagged depletions. If a lined pond results after reclamation, replacement of lagged <br />depletions shall continue until there is no longer an effect on stream flow. <br />
