Light Use Road LU -5 — No reclamation was required for this road. LU -5 was permitted as a <br />light use road providing access to Pond 013 and approved for permanent retention as originally <br />constructed. This area was not considered for bond release because it is within the Pond 013 <br />slide area parcel that will be observed for at least one more year prior to it being eligible for bond <br />release. <br />Structural Demolition — Remaining facilities that had not been released from liability and were <br />not permitted as permanent features include the diesel tanks and explosives magazines. Facilities <br />not yet released but subsequently permitted as permanent features include all remaining culverts, <br />fencing, powerlines, and the substation. All facilities that are not approved for permanent <br />retention were to be removed from the site or crushed and buried within the pit areas. <br />III. OBSERVATIONS AND FINDINGS <br />Yoast Access Road - The road was narrowed in 2007, with excess width in the cut and fill areas <br />of the road being graded to tie into the adjacent undisturbed areas. Regraded sections blend with <br />adjacent contours and are consistent with the approved post- mining topography depicted in <br />Exhibit 20 -2 of the permit application package. The approved postmining width for the Yoast <br />Access Road is 20' (Exhibit 20 -3). The average width of the road surface, as measured during <br />the August 8, 2012 site inspection, was 17'8 ". <br />Overall, drainage along the road surface and regraded areas is effectively controlled. <br />Maintenance issues were observed in several locations (see August 8, 2012 inspection report for <br />specifics), but none of the areas indicated major drainage problems. No signs of instability were <br />observed along the Yoast Access Road. <br />On the north end of the Yoast Access Road, the mine related dragline walking route and <br />associated Routt County Road 27 detour disturbance was reclaimed in 2007. Routt County is <br />constructing a permanent roundabout for Routt County Road 27 within the reclaimed dragline <br />walking route /county road detour. Construction began in July 2012, disturbing the entire 6.25 <br />acre reclaimed area. Since the area has been redisturbed by the county, it was not evaluated <br />during the August 8, 2012 bond release inspection. The Division has determined that the <br />approved postmining land use (rangeland /wildlife habitat) for this area will need to be changed <br />to commercial /industrial, since the area has been converted to a county road. Seneca Coal <br />Company, LLC, will need to revise the permit application package accordingly. When road <br />construction is complete and the approved postmining land use has been implemented, the area <br />would be eligible for full bond release and could ultimately be removed from the permit <br />boundary. <br />Page 8 of 27 <br />Yoast Mine SL -4 <br />
