Friday, October 26, 2012 <br />1. The storage of the tailings must meet the criteria established in Section 8.6 of the Regulations; <br />2. SLV Minerals shall register as a Recycling Facility with the Division. The registration form can <br />be found at: http: / /www.colorado.gov /cs/ Satellite /CDPHE- HM/CBON/125161636098 ; <br />3. SLV Minerals shall submit the annual Recycling Facility Reporting form by May 1 of each <br />calendar year; <br />4. The proposed beneficial use shall comply with applicable local, state and federal laws and <br />regulations; and <br />5. SLV minerals must sample each source of mine tailings, after they have been processed through <br />the custom mill, for speciated radionuclides and metals and the analytical test results shall be <br />reviewed and approved by the Division prior to being beneficially used. Additionally, each <br />source of mine tailings shall be sampled on annual basis to ensure consistency of constituents in <br />the tailings. Annual testing shall occur on mine tailings that have undergone the custom mill <br />process. If test results show consistency, then SLV Minerals may request to reduce testing <br />frequency for individual mine tailing sources. Conversely, if the analytical results show <br />variability the Division will require additional sampling and analysis to demonstrate the safety of <br />the material. The analytical testing shall include those constituents listed on the table attached to <br />this letter. Only those materials with constituents at or below the corresponding level in the <br />"Standard" column may be beneficially used.
