October 2012 Twen Coal, LLC * Phase I Liability Release Application ♦ Page 2 <br />2.1 PHASE 1 BOND RELEASE AREAS <br />2.0 PHASE 1 BOND RELEASE REQUEST <br />Phase 1 partial bond release is requested for the following mine disturbance areas, which are no <br />longer needed to support ongoing or anticipated future mining operations, and which have <br />therefore been reclaimed: <br />• Eastern Mining District (EMD) /9 -Right Ventilation Shaft Installation (2.8 acres, 2009- <br />2010) <br />• 18 -Right Intake Shaft Installation (Pad only - 1.8 acres, 2009 -2010) <br />• Fish Creek Tipple Facility (9.6 acres, 2011 -2012) <br />• Middle Creek Soil Material Stockpile (0.13 acres, 2011 -2012) <br />The requested Phase 1 partial bond release is for completion of facilities demolition, shaft sealing, <br />final backfilling, grading, and drainage control in compliance with the approved reclamation plan <br />and in accordance with applicable provisions of Rule 3.03.1(2)(a). The proposed Phase 1 partial <br />bond release areas are delineated on Map 1. The proposed bond release areas do not include any <br />alluvial valley floors, croplands, or prime farmlands. <br />2.2 DOCUMENTATION OF RECLAMATION STATUS <br />Phase 1 partial bond release is requested for the 5.6 acres associated with the EMD and 18 -Right <br />shaft installations, reclaimed during 2009 -2010, and for the 9.7 acres associated with the Fish <br />Creek Tipple Facilities and Middle Creek Soil Stockpile reclaimed during 2011 -2012. Current <br />reclamation status for the proposed Phase 1 partial bond release areas is documented by CDRMS <br />inspection reports for the years 2009 through 2012; and the 2010 and 2011 Foidel Creek Mine <br />Annual Reclamation Reports, provided as Appendices B and C. <br />2.3 SEDIMENTATION POND RECLAMATION AND RETENTION <br />TC has retained the sedimentation control structures for the Fish Creek Tipple to provide ongoing <br />sediment control until such time as final Phase 3 Bond Release is obtained for this area. The EMD <br />and 18 -Right shaft installations utilize Alternative Sediment Controls, which have also been <br />retained, to provide runoff and sediment control during the reclamation liability period. <br />2.4 CONSISTENCY WITH APPROVED RECLAMATION PLANS <br />Reclamation of the EMD and 18 -Right shaft installations included facility demolition and <br />removal, and plugging and sealing of the shaft openings, in accordance with the approved <br />reclamation plans (Appendix A). Reclamation of the Fish Creek Tipple Facilities included facility <br />demolition and removal for the remaining coal - handling and loadout facilities, except for the <br />railroad spur, substation, and fences. Completion of reclamation for all of these areas also <br />included final backfilling, grading, retention or establishment of drainage controls, and soil <br />material replacement and re- seeding in compliance with the approved reclamation plans and in <br />accordance with applicable regulatory provisions. <br />2.5 DETERMINATION OF PARTIAL BOND RELEASE AMOUNT <br />The determination of the partial bond release amount is based on the calculated reclamation <br />liabilities (10/13/10 CDRMS Mid -Term Review Bonding Calculations, and 10/09/08 Permit <br />Renewal Bonding Calculation Details) associated with the individual reclamation tasks that have <br />been completed for the identified partial bond release areas.
