October 2012 Twentymrle Coal, LLC * Phase 1 Laabrkty Release Application ♦ Page 1 <br />1.2 PERMIT INFORMATION <br />The Mine is an active underground coal mine, and includes associated surface coal processing, <br />handling, and loadout facilities, and associated support and ancillary facilities. The Mine is <br />permitted under an approved Mining and Reclamation Permit (Permit No. C -82 -056), with the <br />Colorado Division of Reclamation, Mining, and Safety (CDRMS). The permit was originally <br />approved and issued on May 23, 1983 and was subsequently renewed at the five -year renewal <br />intervals in 1988, 1993, 1998, 2003, and 2008. <br />1.3 RECLAMATION HISTORY AND STATUS <br />All reclamation activities have been completed in full compliance with the approved reclamation <br />plan (Appendix A), as documented by copies of CDRMS inspection reports (Appendix B). <br />Completion of reclamation for the subject areas is also documented by the 2010 and 2011 Foidel <br />Creek Mine Annual Reclamation Reports (Appendix C), submitted to the CDRMS. Vegetation is <br />well- established on the EMD and 18 -Right shaft sites, although an unusually heavy weed <br />infestation in 2011 affected many areas, including the 18 -Right Shaft site. TC addressed the <br />problem through site - specific weed control efforts, and completed supplemental seeding of the 18- <br />Right Shaft site in late fall 2012 to reinforce earlier seeding efforts, and establish a healthy, self - <br />sustaining vegetative cover which will reduce the potential for weed reestablishment in the future. <br />The Fish Creek Tipple area and associated soil stockpile area were seeded in the fall of 201 land <br />early spring of 2012, however, drought conditions during 2012 resulted in poor vegetative <br />establishment, so these areas were re- seeded in late fall 2012. <br />TC plans to monitor vegetative reestablishment for these areas over the next 1 -3 years, and will <br />then schedule revegetation success monitoring, as appropriate. TC also maintains an ongoing <br />post - reclamation management program consisting of regular inspections of reclaimed areas, <br />stabilization or repair of any rills and gullies that may develop, and noxious weed control <br />measures. <br />TC has retained the sedimentation control structures for the Fish Creek Tipple to provide ongoing <br />sediment control until such time as final Phase 3 Bond Release is obtained for this area. The EMD <br />and 18 -Right shaft installations utilize Alternative Sediment Controls, which have also been <br />retained, to provide runoff and sediment control during the reclamation liability period. The <br />access road for the Fish Creek Tipple and 18 -Right Shaft Installation has also been retained to <br />provide continuing access for site inspection and maintenance. Dependent on land -use plans at the <br />time of final bond release, this road may either be reclaimed or permitted as a permanent road and <br />retained. <br />1.4 BOND INFORMATION AND STATUS <br />The current reclamation bond (Bond SB -008) for the Foidel Creek Mine, is a self -bond in the <br />amount of $10,056,089. The current bond amount reflects a number of adjustments to the bond to <br />address approved revisions for new disturbances or facilities, the most recent of which was MR12- <br />264. Due to a recently approved bond reduction request (TR12 -79), the amount of bond currently <br />held by the DNR exceeds the total calculated bond liability <br />
