Climax Mine Permit Amendment
November 14 , 1980
Page Two
Mining Plan and no fundamental changes to the previously
approved Reclamation Plan. The two additions to the Mining
Plan are the construction of a potable water reservoir in the
Upper Arkansas Valley and the construction of a spill
prevention control dam in the Lower Tenmile drainage below
the existing water treatment plant. Besides fulfilling those
two facility requirements , the Amendment serves simply as a
housekeeping document by 1) incorporating islands previously
designated as non-disturbed land , 2) changing boundaries from
jagged to straight lines, 3) allowing breathing room with the
incorporation of buffer zones , 4) incorporating into our
permit, a number of pre-1969 disturbances for which a
reclamation commitment already exists , and 5 ) slightly
refining some of the existing engineering and reclamation
detail .
The Amendment does not propose any significant change in
the Mine Plan, in the size or location of any facilities , or
the addition of facilities besides the two dams mentioned
above ; nor does the Amendment propose any basic change to our
commitment to reclaim. Our intention is still to mine the
orebody and reclaim the disturbance as stipulated in the
existing permit.
Question C. 3 requested us to supply a site specific soil
inventory on all areas yet to be disturbed .
The law requires the operator to . . indicate on a map
or by a statement, the general type , thickness and
distribution of soil . . . " We have more than adequately
satisfied this requirement by providing both a discussion and
a map ( correlated with vegetation) of the soils throughout
the entire area, including the Amendment lands, showing type ,
thickness and distribution.
Question D.1 requested that we respond to a memorandum
from the Division of Wildlife .
We have carefully reviewed the questions submitted to
you by the division of Wildlife . We have concluded that each
question falls into one or more of the following categories :
