(9) Adverse characteristics of the surface and the substitution of alternative areas: The <br />Operator /Applicant understands that where adverse characteristics of the surface exist, and it is not <br />feasible to remedy by artificial measures, that substitute acres may be reclaimed. <br />3.1.11 Buildings and Structures: <br />The site is privately owned surface and the minerals is appurtenance to the land. The site does not <br />fall under the State Historic Preservation Office Requirements for a cultural or historical study. <br />Certain structures and buildings related to the post mining land use, developed water resource, will <br />be required for its proper functioning and will therefore be left as part of the post mining land use. <br />These buildings and structures will comply with applicable local building codes and ordinances. <br />3.1.12 Signs and Markers: <br />(1) Facility entrance sign: The Operator /Applicant will post a sign, clearly visible from the <br />points of access with the following information: <br />(a) Operator's name. <br />(b) A statement that the reclamation permit for the operation has been issued by the Colorado <br />Mined Land Reclamation Board. <br />(c) The permit number issued for the MLRB permit. <br />(2) Affected area boundary markers: The boundaries of the affected area will be marked with <br />monuments that are clearly visible. This is proposed as an 112c Regular Operations operation. <br />Therefore, the permit boundary and the affected area boundary may not necessarily be the same. In <br />addition, the Operator /Applicant is proposing a floating bond to cover various portions of the mine <br />site, allowing mining and reclamation to be on going. <br />(3) Alternative methods of affected area boundary identification: At this time the <br />Operator /Applicant plans to mark the affected area boundary with monuments. <br />This ends the requirements of Section 3.1, .Reclamation Performance <br />Standards. The narrative will resume with the remainder of Section 6.4.5. <br />Continuation of the Reclamation Plan: <br />6.4.5(2) (d) Where applicable, the Operator /Applicant has developed plans for the <br />segregation, preservation, replacement, compaction, and grading of soil used for revegetation. The <br />Revegetation Plan will contain a list of preferred plant species to be planted following the <br />recommendation of the NRCS Field Office. (Please see 6. 4.5(2) (f) (ii) below.) The selected <br />species for erosion control and site stabilization should all be readily available commercial <br />materials. <br />Seedbed preparation was covered in Section 3.1.10(5) of this document. <br />(e) Reclamation Schedule: The reclamation schedule is described in the previous Sections of <br />this document, specifically in Sections 3.1.3 and 3.1.5(4). To further elaborate, the first part of <br />reclamation will begin prior to mining. The site will be prepared for installation of the slurry wall <br />in Phase One. The slurry wall will be installed. The site will then proceed to the mining phase as <br />discussed earlier and below. Mining will be done in phases as discussed in the Mining Plan and as <br />shown on the Mining Plan Map, Exhibit "C ". Reclamation will follow each phase of mining and <br />will include in -slope stabilization. The perimeter of the excavations will be reclaimed upon the <br />conclusion of mining in each Phase. A number of stockpiles will occur also along the north edge of <br />the Operations. The area underlying these stockpiles will not be reclaimed until the stockpiled <br />material is disposed of. Dependent upon the Operator /Applicant's ability to dispose of the <br />stockpiled material, the Operator /Applicant may choose to grade in- place, cover with topsoil where <br />needed and seed any remaining stockpiles. <br />
