d) Culverts C23a, C52 and C54 are shown on the map but were not found on the ground. Please <br />reinstall these culverts or demonstrate that they are not necessary and remove them from the <br />map. <br />24. Refuse Disposal Area (RDA): <br />a) Drainage off the east side of the Cell tower disturbance area needs to be passed through <br />sediment control measures. Please submit a design for alternate sediment control (SAE) for <br />the portion of the area that drains to the east (Rule 4.05.2(3)(b)(i)). <br />b) Map 13 does not depict the light use road that runs along the east side of the RDA conveyor. <br />Please show this light use road on the map. <br />c) Map 13 shows a light use road crossing over the top of the RDA. Although this is a drive <br />path that NECC uses to access the pile, it does not meet the definition of a light use road. <br />Please remove this light use road designation from Map 13. <br />d) Please show the light use road from the north side of the RDA to the Cell Tower pad on Map <br />13. <br />e) Please show the light use "zig -zag" road on the southeast side of the RDA on Map 13. <br />f) Please add the location and identify the culvert under the conveyor on the east side of the <br />RDA. <br />25. There appears to be a variance in naming conventions regarding the Development Waste Pile <br />(DWP) and the Development Waste Disposal Areas (DWDA No. 2 and DWDA No. 3). Maps <br />11 and 13, and Table 19 refer to the development waste pile constructed to the west of the mine <br />entrance gate as "Developmental Coal Waste Pile ". Approved permit pages 2.05 -4a and 2.05 -44 <br />refer to the same pile as "Development Waste Pile" (DWP). Two development waste piles <br />permitted subsequent to the Development Waste Pile are referred to as Development Waste <br />Disposal Areas No. 2 and No. 3. Please bring the permit text and the map labels and legends into <br />agreement and refer to the development waste piles with a consistent naming convention. <br />26. Table 24 provides information regarding the topsoil mass balance for the RDA. Topsoil pile No. <br />2 was moved from west of the RDA conveyor to west of the mine access road. Additional <br />topsoil was added to topsoil stockpile NO.2 during the construction of the Bates portal, and a <br />subsoil stockpile was constructed adjacent to topsoil stockpile No. 2. <br />a) Please provide an accurate topsoil and subsoil mass balance for all areas at the mine that are <br />required to receive topsoil in accordance with maps 15 and 16 (update Table 24). <br />b) Please update section 2.05 in the permit to reflect the current location of all existing and <br />proposed topsoil piles. For example, a topsoil pile south of containment area east of the <br />sediment drying area is not shown on a map. <br />c) If available topsoil and subsoil volumes are inadequate to achieve the required cover on the <br />RDA and Development Waste Disposal Areas, please define how NECC will obtain <br />adequate material. <br />15 <br />
