21. During an on -site inspection conducted September 18 -20, 2012, the Division found discrepancies <br />between permitted locations of ditches, sumps, and culverts and the on- the - ground locations. <br />a) Please bring sediment control system ditches, culverts and sumps into agreement with the <br />approved sediment control plan shown on Map 13 (dated 7/25/2012, last update TR66) or <br />revise Map 13 to conform to the on- the - ground systems with documentation that the on -the- <br />ground designs are adequate to pass the design requirements. <br />b) NECC personnel have indicated that the development waste conveyor will no longer be <br />needed. NECC has already begun partially dismantling structures associated with this <br />conveyor. Please remove this conveyor. Please remove culverts C70 and C71. Please <br />remove the fill downstream from the highway culverts that pass surface runoff and Pond 8 <br />emergency discharge under the highway and re- establish the open channel. Please restore <br />containment area 4. <br />c) The elevation of culvert 14A inlet is higher than the highway culvert outlet upslope from it. <br />NECC needs to adjust the elevation of culvert 14a accordingly. <br />d) Since the acceleration/deceleration lane construction on Highway 12 this summer, the maps <br />no longer accurately depict the elevation contours on the north side of the RDA haul road <br />intersection with the highway. Please update the map contours to reflect on- the - ground <br />conditions. <br />22. Please update maps to depict actual location of all structures at the facilities area: <br />a) The location of where the Bates Portal Conveyor joins with Rock Breaker Building does not <br />agree with Map 11 and Map 13. <br />b) The location of temporary truck loading chute and the location of water lines installed in <br />2011 and 2012 are not shown accurately on Map 11. <br />c) An apparent light use road south of the East fan and south of Pond 001 is not accurately <br />depicted on the surface facilities maps (Map 11 East Portal, and Map 13 Sediment Control). <br />d) The Bates portal fan housing and portals (conveyor portal) are not accurately depicted on the <br />Sediment and Surface Water Control map (Map 11 -Sheet 3 was updated with the approval of <br />TR66). Please bring Map 13, and any other maps that depict the locations of surface <br />facilities, into agreement. <br />e) The clean water ditch and sediment control system at the Bates portal area is out of <br />agreement with Map 13. The sediment control system in this location needs to be re- <br />evaluated, revised if necessary, and installed in accordance with the approved design. <br />f) During a Division inspection in October 2012, the inspectors observed NECC removing a <br />portion of Culvert C2, located west of the C &W building. It was mentioned by NECC that a <br />second portion of Culvert C2 will also be removed in the future, leaving the center portion of <br />Culvert C2 in place. Please update these changes on Map 13. <br />g) During a Division inspection in October 2012, NECC extended Ditch D6, located on the west <br />side of the subsoil stockpile storage area. Please accurately depict this ditch extension on <br />Map 13. <br />13 <br />
