COMMENTS
A complete inspection of the New Horizon Mine was conducted by Marcia Talvitie of the
DRMS on Tuesday, October 23, 2012. The inspection began at 11:30 a.m. with a records check.
Ross Gubka accompanied me during the field portion of the inspection. The weather was warm,
dry, and windy.
PERMITTING UPDATE:
SL-13 The Division issued a Preliminary Adequacy Review letter on October 17, 2012. Once
all adequacy issues are resolved, the Division will recalculate the reclamation cost
estimate and compose the bond release findings document.
PR-07 An application for Permit Revision No. 7 was received by the Division's Denver office
on October 17, 2012. A determination on the completeness of the application will be
made no later than Monday, October 29, 2012.
RN-06 On August 27, 2012, the Division issued a letter notifying WFC that the New Horizon
Mine permit will expire on May 26, 2013. A complete application for Permit Renewal
No. 6 must be received no later than November 27, 2012.
AVAILABILITY OF RECORDS —Rule 5.02.4(1):
• Permit records for the mine were available for review at the mine office. A completed
DRMS Availability of Records form is attached to this report.
• WFC submitted an updated APEN form to the Air Pollution Control Division of the CDPHE
on December 10, 2010. We were not able to find a response from the APCD, which would
typically be in the form of a"new" —5-year permit for the site. Mr. Gubka said he would
inquire of Western Fuels' Denver office to see whether the APCD had issued the permit, and
follow up with the APCD if necessary.
