Project at SH 85 near Ft Lupton
Frederick, Michael
From: Adam Smith [adam@civilresources.com]
Sent: Wednesday, January 30, 2008 9:31 AM
To: 'Sherman, Mike'; chris.mettenbrink@state.co.us
Cc: Frederick, Michael;'Eussen, James
Subject: RE: Project at SH 85 near Ft Lupton
Attachments: Site Location Map.pdf
Mike and Chris,
Attached is the Site Location Map for the Lupton Lakes Dewatering Outfall Project. This project includes boring under
Highway 85 and a baffle and rip rap on the west side of the highway. It is located approximately 4080 feet north of the
intersection of Highway 85 and Weld County Road 8. Specifically, the bore is designed 10 feet south of the existing 36
inch RCP pipe under the highway. It appears from the emails below that we are out of the nighttime roost protected area
(1/4 mile) for the bald eagle nests just south of Weld County Road 8. Are there any forms that I need to fill out or any
other information that you need so that we can get a letter stating that we are out of the protected area and may proceed
with the CDOT Utility Permit?
Thank you for your time,
Adam Smith, P.E.
Civil Engineer
Civil Resources, LLC
323 5th Street
P.O. I emailed them this morning after our meeting and Mike's
response is below. Assuming, this is in fact the distance from the project site, 3/4 to 1/0 miles, it will be outside the
nighttime roost protected area for bald eagles. The Colorado Division of Wildlife recommended buffer zone and seasonal
restriction for bald eagles is 1/4 mile between November 15 and March 15. But since the project is within the vicinity
of WCR 8, CDOT will need to know the exact construction locations and its distance from the nighttime roost before
issuing a permit.
Please call or email me if you have any questions or concerns.
Thank you,
James Eussen
1/30/2008
1, f e' j c
