DESIGNATED CHEMICALS EVALUATION <br />Size Size <br />(ft') (acres) <br />67,071 1.54 <br />3,950 0.09 <br />5.1 Rationale <br />Section 6.4.20(5) of the Hard Rock /Metal Mining Rules and Regulations ( "Rules ") requires that an EPP <br />contain a presentation and discussion of the types, quantities, and concentrations of "designated chemicals" <br />within the permit area, and to the degree such chemicals are present or used within the permit area, shall <br />characterize the designated chemicals as to: <br />a) Their known potential to affect human health, property or the environment; <br />b) Based on the best information available at the time of submittal of the Environmental <br />Protection Plan, specify the expected concentrations, process solution volumes and fate of <br />designated chemicals to be used in existing and proposed extractive metallurgical processes at <br />the mine, and /or mill site, if applicable; and <br />c) Provide, to the extent reasonably available, material safety data sheets for designated <br />chemicals. <br />5.2 Types, Quantities, and Concentrations of Designated Chemicals <br />Rule 1.1(13) defines designated chemicals as "toxic or acidic chemicals used within the permit area in <br />extractive metallurgical processing, the use of which, at certain concentrations, represents a potential threat <br />to human health, property or the environments ". No extractive metallurgical processing will occur on site <br />at the JD -6 Mine. All ore will be transported offsite for processing. <br />There are no designated chemicals in use or planned for use at the JD -6 Mine. Diesel fuel is not a <br />designated chemical (DRMS, 2011). Although petroleum products are not designated chemicals, they must <br />be properly handled and stored. During the operation of the mine, less than 1,320 gallons of fuel and oils <br />will be stored on the property. Because the volume of fuel and oils stored onsite will be less than the <br />regulatory threshold of 1,320 gallons, a spill containment plan is not required (40 CFR 112, U.S. EPA Spill <br />Prevention, Control, and Countermeasure Regulation). Any oils or lubricants stored on the surface will be <br />located within a bermed and lined catchment. Storage areas will be routinely inspected and the berms will <br />be maintained as described in the Materials Handling Plan. In addition, stormwater BMPs will be routinely <br />monitored and maintained as described in Attachment 3. <br />Although fuels and lubricants are not considered designated chemicals, they are stored in compliance with <br />regulatory requirements to minimize the potential for release to the environment.
