Counting the claimants electing <br /> Class 8 treatment, ballots were received from 30 <br /> claimants, holding a total of $209, 016 in claims. <br /> (i) Twenty-seven Class 8 claimants accepted the Plan, <br /> which is 90% of the number of such claimants voting <br /> on the Plan. Three Class 8 claimants rejected the <br /> Plan. <br /> (ii) The claims held by accepting Class 8 claimants <br /> total $197, 1251, which is 94 .3% of the amount of <br /> Class 8 claims voting on the Plan. Claims held by <br /> rejecting Class 9 claimants total $11, 891. <br /> i. Class 9 -- General Unsecured Claims Exceeding <br /> 10 000. Class 9 consists of each allowed claims not <br /> otherwise classified under the Plan, including all claims <br /> which are secured by consensual liens, judgment liens, <br /> mechanics' liens, or other liens whose priority under <br /> state law is junior to Sanwa. Scheduled and filed claims <br /> in Class 9 total approximately $16. 1 million. Ballots <br /> were received from 18 claimants, holding a total of <br /> $10,925, 155 in claims. <br /> (i) Fourteen Class 9 claimants accepted the Plan, which <br /> is 77 .8% of the number of such claimants voting on <br /> the Plan. Four Class 9 claimants rejected the <br /> Plan. <br /> (ii) The claims held by accepting Class 9 claimants <br /> total $10,743,872, which is 98.3% of the amount of <br /> Class 9 claims voting on the Plan. Claims held by <br /> rejecting Class 9 claimants total $181,282. See <br /> Paragraph 6 below. <br /> j . Class 10 -- Pitkin Iron Corporation. Class 10 <br /> consists of the pre-petition claims of Pitkin Iron <br /> Corporation. The scheduled amount of the claim is <br /> $3,688,342. No ballot was received from the Class 10 <br /> claimant. The Class receives nothing under the Plan and <br /> thus is presumed to have rejected the Plan. See <br /> Paragraph 7 below. <br /> k. Class 11 -- Former Shareholders. Class 11 consists <br /> of the claims arising from the sale to the Debtor of the <br /> Debtor's common stock by former shareholders . Scheduled <br /> and filed claims in Class 11 total approximately $2 .7 <br /> million. Ballots were received from all 8 claimants. <br /> 3 <br />
