d. Class 4 -- Sanwa. Class 4 consists of the claim of <br /> Sanwa Business Credit Corporation, which is secured by <br /> substantially all real and personal property of the <br /> Debtor. A ballot was received from the claimant <br /> accepting the Plan. Such ballot constitutes consent to <br /> the voluntary subordination of Sanwa's secured claim to <br /> tax priority claims and claims in Classes 5, 6, 7 , 8 and <br /> 9. <br /> e. Class 5 -- Reclamation Claimants. Class 5 consists <br /> of the claims of the Colorado Mined Land Reclamation <br /> Board (the "MLRB" ) , the Colorado Department of Natural <br /> Resources, Division of Mineral Geology (the "DMG" ) , and <br /> the United States Department of Interior, Office of <br /> Surface Mining Reclamation and Enforcement (the "OSM" ) <br /> for reclamation of the Debtor's mine site and two <br /> quarries, secured by the Debtor's rockdust plant, a lien <br /> on the Debtor's Carbondale Industrial Park limited in <br /> amount to $7 , 000, and two certificates of deposit in the <br /> approximate amount of $4,500. A ballot was received from <br /> the DMG accepting the Plan, and a ballot was received <br /> from the OSM rejecting the Plan. See Paragraph 4 below. <br /> f. Class 6 -- Environmental Claimants. Class 6 <br /> consists of all claims for environmental remediation of <br /> any property owned by the Debtor, specifically including <br /> such matters as removal of asbestos, underground storage <br /> tanks, PCB-contaminated items, or other hazardous <br /> substances, and monitoring and treatment of water <br /> discharging from the Debtor's mine, and specifically <br /> excluding Class 5 reclamation claims. No ballots were <br /> received. See Paragraph 5 below. <br /> g. Class 7 -- General Unsecured Claims Not Exceeding <br /> 200. Class 7 consists of general unsecured claim not <br /> exceeding $200 in amount, and each general unsecured <br /> claim exceeding $200 which is voluntarily reduced by the <br /> claim holder to the sum of $200, excluding Class 10, 11, <br /> and 12 claims. Class 7 claims are unimpaired under the <br /> Plan, and thus are conclusively presumed to have accepted <br /> the Plan. Thirty Class 8 claimants elected to be <br /> included in Class 7 . <br /> h. Class 8 -- General Unsecured Claims Exceeding $200 <br /> But Not Exceeding $10,000. Class 8 consists of general <br /> unsecured claims exceeding $200 but not exceeding $10, 000 <br /> in amount, and each general unsecured claim exceeding <br /> $10,000 which is voluntarily reduced by the claim holder <br /> to the sum of $10,000, excluding Class 10, 11 and 12 <br /> claims. Scheduled and filed claims in Class 8 total <br /> approximately $393,000. In addition, fifteen Class 9 <br /> claimants elected to be included in Class 8, thereby <br /> 2 <br />
