On page 2.05 -73 under Rule 2.05.6(6)(c) Subsidence Monitoring, please be <br />more specific about when monitoring will begin, how long it will continue, <br />the frequency of monitoring, what will be monitored, when can it end, and <br />what, if any, mitigation is proposed should monitoring indicate the need. <br />119. The permit boundary is incorrect on Figure 2.1 -3 in the southern area. Please <br />correct this figure. <br />An Alluvial Valley Floor (AVF) report prepared by ERO Resources Corporation <br />dated December 17, 2009 is found in Volume 1 Appendix W of the Permit <br />Revision No. 2 application package. <br />A thorough investigation of the proposed coal mine waste pile south of the <br />McClane Canyon Mine surface facilities has been deemed adequate in <br />accordance with Rule 2.06.08(3). There is an appropriate combination of studies <br />concluding a negative AVF determination by the Division. <br />Nearly 95 percent of the investigation area is covered by various deposits that <br />resulted from unconsolidated runoff or slope wash, talus, and landslide deposits. <br />Therefore, Rules 2.06.8(3)(c)(ii)( A and C) are met. <br />The two areas with exposed older alluvium total slightly more than one acre <br />which is considerably smaller than the smallest currently cultivated parcel along <br />East Salt Creek (9.1 acres). Therefore, these alluvial areas do not meet the <br />regional practices criterion, as required by Rule 2.06.8(3)(c)(ii)(B). <br />In summary, the Division finds that the area for the proposed coal waste <br />pile is not an alluvial valley floor and this negative finding has been <br />reached in accordance with 2.06.8(3). <br />MCM: While the coal mine waste pile is no longer proposed, the Operator will <br />incorporate the Division's findings into the permit document. A discussion will <br />begin on page 2.06 -2. <br />
