Mike Boulay <br />Rule 2.04.9 Soils Resource Information <br />-10- <br />October 16, 2012 <br />MCM: Comment noted. The discharge permit is in the administrative review process <br />and will be submitted to DRMS upon issuance. <br />21. Please state in Section 2.04.5 and Section 2.04.7 whether East Salt Creek <br />and Big Salt Wash are perennial, intermittent or ephemeral streams. Also, <br />please state in the permit text whether any of the ephemeral streams within <br />the permit area have drainage areas greater than one square mile. <br />MCM: Please see revised page 2.04 -6 and page 2.04 -25. <br />22. Rule 4.05.18 requires that the Division make a finding for disturbances within 100 <br />feet of a perennial stream, an intermittent stream or an ephemeral stream with a <br />drainage area greater than one square mile. First, several disturbed areas are or <br />will be within 100 feet of East Salt Creek. Please provide pertinent information <br />in the permit text that demonstrates compliance with 4.05.18. Second, <br />please provide similar information if any of the ephemeral drainages are <br />greater than one square mile in size. <br />MCM: Please see revised page 2.05 -54. The text on page 2.05 -54 was approved with <br />TR -16 as DRMS made a negative determination in accordance with Rule <br />4.05.18(1) (item #58, DRMS letter dated July 21, 2008). <br />Note: Please remove Section 4 from the permit document. Applicable soils text <br />from Section 4 from the old permit document has been replaced with <br />section 2.04.9. <br />23. The baseline soils information is found in Appendix T in the permit revision <br />application. An Order 1 -2 soil survey was conducted on 50 acres, the area <br />proposed for the new facilities. According to Rule 2.04.9 (1)(c), a soils map or <br />enlarged aerial photo of the same scale as the permit area map shall be <br />provided. The map provided (Figure 1) in Appendix T does not show a scale, but <br />instead, instructs the Division to look at Table 1 for a scale legend. In Table 1, <br />there is no scale legend to refer to. Please change Figure 1 map to include a <br />scale, at the same scale as the permit area map. <br />MCM: Please see revised soils map, Figure 1. <br />24. In the permit revision application, page 4- 31(1)(e) says that a discussion of <br />potential productivity of the soils is located in the soils discussion beginning on <br />page 4 -35. On page 4 -35, prime farmland investigation is the only subject matter <br />discussed. Please amend this discussion to provide more information on <br />the potential productivity of soils, besides the request for negative <br />determination of prime farmland. <br />
