10. 04. 94 02 : 46 PM *MID- CONTINENT CBDL P02
MID-CONTINENT RESOURCES, INC.
PRODUCERS OF THE FAMOUS COAL BASIN COKING COAL
1068 COUNTY ROAD 100• Box 600
CARGONDALE,COLORADO$1823
TLX
MAIN OFFICE (303)963-2S81 450724
DISTRICT OFFICE (M3)063-0666 FAX
WARENOUBE (303161143223 (303)063,26%
October 4, 1994
Mike Long, Director
Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, Co 80203
RE: Modifications to piping across Dutch Creel;.
Dear Mr. Long:
John Reeves has written you twice concerning modifications which
we believe to be needed for the pipe which extenda across Dutch
Creek and carries runoff from the preparation plant yard to
settling ponds.
A failure of the pipe during winter weather conditions would mean
that the runoff from the yard area could not reach the ponds, an
required. Tn years past Mid-Continent had employees on-site
throughout the winter months to monitor the pipe and keep it from
freezing and collapse. As there is no funding source which would
allow Mid-Continent to maintain a work force at the site through
the winter, it is important that steps be taken to augment the
structural support of the pipe.
Time has now become a critical factor, as this work should not be
done under snow and wet conditions, which we are now approaching
at this site.
Mid-Continent has not received any response from you as to
whether you have received and read the previous letters, whether
you will take steps l.o safeguard the pipe, of whether you will
authorize Mid-Continent to proceed with the necessary
modif icuLlons .
Please advise me as to your intention-. Mid-Continent is ready to
perform the work immediately.
As Trustee for the estate, it is my responsibility to ensure that
the az sets of the estate are protoc-ted, which includes but is not
limited to the use of funds to carry out the Bankruptcy plan
which in turd includes the Reclamation Plan .
