As
we discussed, one of the large drainage ditches your division has proposed to be
constructed along the base of the Sutey Refuse Pile pursuant to Bid No. MVC-MINES-345
appears to follow the path of the access road to the Thompson/Willison property. That
access road follows a deeded easement purchased from Mid-Continent with the property.
From our discussion yesterday, we understand that your agency does not intend to
block access to the Thompson' and Willisons' property in any way. We understand that
the current access road will be moved as necessary and that a deeded easement will be
acquired from Mid-Continent for any location to which the access road is moved. It is our
understanding that your agency will bear all expenses of these actions.
If I have misunderstood our conversation or what your agency contemplates, please
let me know. If this letter raises any questions or concerns please feel free to call.
Sincerely,
FLINT B. OGLE
FBO/ks
PC: Bill and Pat Thompson
Tom and Linda Willison
