Ms. Bernard <br />Page 12 <br />October 16, 2012 <br />6.4.3 Exhibit C — Pre - Mining and Mining Plan Map(s) of Affected Lands <br />2. The maps which were submitted for Exhibit C did not conform to the requirements of Rule <br />6.2. Please revise each of the maps to include the following elements: <br />a) The name of the Applicant <br />b) Must be prepared and signed by a registered land surveyor, professional engineer, or <br />other qualified person <br />c) A north arrow <br />d) A map scale (not larger than 1 inch = 50 feet, nor smaller than 1 inch = 660 feet) <br />3. The map labeled as `Exhibit C (b,g)' did not contain the fence on the west and north side of <br />the property. Please revise the map to show the fence(s) as well as the owner's name. <br />4. The map labeled as `Exhibit C (c) contained contour lines; however, the contour lines did not <br />contain elevation labels. Please revise the map to show the associated elevation of each <br />contour line. <br />5. The map labeled as `Exhibit C (d) depicts the affected area with the permit boundary. Please <br />specify how many acres, within the 31 acre permit boundary, will be affected by the mining <br />operation. <br />6.4.4 Exhibit D — Mining Plan <br />6. The Applicant has stated the site will be operated intermittently. Please be aware intermittent <br />status may only be applied to sites with weather, wildlife or jurisdictional restrictions; sites <br />may not remain inactive for reasons related to market conditions. If a site is inactive for 180 <br />consecutive days or more, then the Operator will need to file a Notice of Temporary <br />Cessation in accordance with Rule 1.13.5. <br />7. Please describe how the access road along the southeast portion of the property will be <br />stabilized to prevent erosion from stormwater runoff. Also, please clarify if any <br />improvements will be made to the access road. <br />8. The Applicant has stated that any part of the permit area may be worked at any given time. <br />The Financial Warranty is based on the estimated cost of reclaiming all lands to be effected <br />within any single year, plus all lands affected in previous permit years and not fully <br />reclaimed Please specify how many acres of land will require reclamation at any given time. <br />9. Please clarify if the area in front of the outbuilding will be utilized for pallet storage or any <br />other use related to the mine operation. <br />
