Issue 2 <br /> The TDN cites a failure to identify all owners and/or controllers <br /> of the mining operation. The accompanying inspection report <br /> indicates that Pitkin Iron is the operator of the Coal Basin Mine. <br /> The permit application indicates that Mid Continent Resources Inc. <br /> is the operator. The Division does not agree that Pitkin Iron is <br /> the operator. Pitkin Iron is however, an owner or controller of <br /> the operation, based upon the definition in Rule 1.04 (83a) (b) (iii) <br /> which refers to the ability to commit financial assets or working <br /> resources. <br /> During the inspection, representatives who are conducting the <br /> ongoing reclamation work indicated that they were employees of <br /> Pitkin Iron. It is the Division's understanding that Pitkin Iron <br /> has contracted with Mid Continent Resources to perform the required <br /> reclamation work. Therefore, information regarding the ownership <br /> and control of Pitkin Iron should be included in the permit <br /> application. The Division issued NOV C-93-108 for failure to <br /> identify all owners and controllers of the operation in the permit <br /> application. <br /> Issue 3 <br /> A response to this issue will be forwarded to the AFO on July 9, <br /> 1993 . <br /> Issue 4 <br /> The TDN cites a failure to reclaim portions of an old stream <br /> crossing on the road to the No. 5 Mine. This issue, as is number <br /> three, regards contemporaneous reclamation. As we discussed today, <br /> DMG will provide a response to issues three and four on Friday, <br /> July 9, 1992 . That response will discuss the site reclamation <br /> issues. <br />
