As we discussed during our <br /> phone conversations today, a response to items three and four of <br /> the TDN will be forwarded to the AFO on July 9, 1993. Additional <br /> time was requested so that our Attorney General representative <br /> could review our responses. Thank you for granting the additional <br /> time to provide an appropriate a response. This letter serves as <br /> the Division 's response to issues one and two of the TDN. <br /> Issue 1 <br /> The TDN cites a failure to inspect the old coal refuse pile at the <br /> mine on a quarterly basis, as required by Colorado Rule 4.10.2. At <br /> the time of the inspection, DMG inspectors understood that the Coal <br /> Basin permit allowed for semi-annual inspections of the refuse <br /> pile. This would have been a permit defect. The operator has been <br /> conducting semi-annual inspections for the past several years. <br /> Upon further review of the permit (specifically Chapter II, pages <br /> 42-3) , it appears that the frequency of refuse pile inspections is <br /> not addressed. Therefore, the Division issued Notice of Violation <br /> C-93-107 for failure to conduct quarterly inspections of the refuse <br /> pile. A copy of the NOV is enclosed. <br />
