A copy of <br /> the appeal request is attached. In that appeal (para 1, Page 3) , <br /> DMG indicated that a geotechnical investigation of the pile would <br /> be initiated and concluded within thirty days. Steve Renner asked <br /> that you plan another visit to the site to evaluate the apparent <br /> instability of portions of the pile. <br /> In essence, we need a determination as to whether the ditch at the <br /> toe of the pile is a cause of instability of the pile. Since the <br /> pile is a pre-law structure, the operator presently has no <br /> liability for the lower portions of the pile. However, if it is <br /> determined that instability of the pile is a result of the ditch <br /> (which has been used and maintained throughout the life of the <br /> mine) , an enforcement action including that portion of the pile may <br /> be appropriate. <br /> Please let Tony Waldron know when you will be able visit the site <br /> and if any additional assistance is needed.
